In continuation from my earlier post, the company immigration attorney says if I am working for 32 hours per week and get paid for 32 hours (32 hours is considered a full time employee in our company with all the benefits), an amended petition for part time employee need not be filed. The attorney even says if and only if I work for less than 30 hours per week and get paid according to it, then an amended petition has to be filed for part time employee (in which case you also loose all your benefits too). Has anyone come across this situation.

Don't use AR11. But go online or call USCIS to change the address on your 485.
I was sugested by an officer to chage mine to a friend's or a reletive's, after I asked him what if I couln'd get an RFE because I was outside the US.

Becoming Canadian would only help if you could keep your PD- and as noted still not possible because they go by birth not citizenship.
I'm Canadian and you see my PD. Not as badly off as folks from India or China, but still a long wait, and a new Canadian applying now will have a long wait.

Thank you everyone for all the replies..
I'm applying to UGA and Georiga Tech as of now, among other colleges, but those are the only ones with the in state/ out of state issue..
My father said he will be getting his 485 receipt soon.. maybe in a couple months time.. would having that qualify me any better?
I am planning to call them on wednesday as they are only open till 5 and I have school..

Well its grey area...I think its ok to process payroll from Texas. You can say that
my base area is texas like IBM etc have a base and the payrolls are process from there and not where the client is.
In fact most likely the labor petition is from texas. I doubt the employer even file a labor when he moved to NJ, so in way actually its good that he is processing from texas.
For that reason only peopl are getting arrested?

Can you please share with us how you got USCIS to use cross-chargeability in your case. Since cross-chargeability is difficult to prove members suggest that a few things should be done simultaneously, to get all their attention:
1. Letters and faxes to the USCIS.
2. Infopass appointment.
2. Contact your local congressmans office and request them to follow up.
3. If possible also take help from AILA, which your attorney would have to do.
What are your experiences. Can you please share what you had to do to get cross-chargeabbility accepted. Also at any point during your process did you get a letter from USCIS stating that they will use cross-chargeability for your case?

The increase in illegal immigration poses many challenges to our communities
and our broken immigration system must be fixed. My colleagues and I who

have broken the law. However, our economy depends on their hard work. The farming, food service, and construction sectors would essentially cease to exist without immigrant workers.
The vast majority of illegal immigrants come here to work. The best way to
control illegal immigration is to strictly enforce laws that require
employers to hire citizens or legal immigrants. First we have to ensure
that our laws allow for sufficient legal workers. The legal immigration
system is relatively generous for family members of citizens, but it is
nearly impossible to immigrate for employment. In 2004, only 359 people
were admitted in the category of "unskilled shortage workers," which is why
so many illegal immigrants come to fill those jobs.
I support legislation similar to the Senate compromise to bring legal
immigration in line with the supply of jobs not taken by citizens. H.R.
2330, the Secure America and Orderly Immigration Act, would create a system
whereby, if a job went unfilled by American citizens, the person who filled
that job would be able to get a temporary visa and, if they kept the job for

I understand the option of re-entering the country with a new visa, which may be the best way to go. However, there isn't much time left till Oct 31, 2008, and I am wondering if there is any other way to resolve the problem.
1) How does one apply for the extension of the I-94. Which form should be used, and how long does it take?
2) Can one go to the nearest port of entry with the both the current and new H-1B approval notice and request them to extend/give a new I-94 till 2011?
3) What if he goes to say Canada next weekend, and on his return shows both the H-1B approval notices:
Current one: expires on Oct 31, 2008
New one: Nov 1, 2008 - Oct 31, 2011
Will the IO at the POE give him a new I-94 that is valid till 2011?
Please advise.

He has a stamped H1 till Oct 31 2008 . He is an H1 extension of I 1797 till Oct 31 2011. There are two things one can do.
-Go to CBP and try to convince that you did not show the 797 with validity till Oct 2011 by mistake /error or stress so please correct the I 94.
-Else if the above does not work take a small trip and travel outside and return back before your visa stamp ends(Oct 30 2008) , while at reentry show you visa stamp as well the 1797 with validity till oct 2011 , the POE has to issue you I 94 till oct 2011.
-or else just take an appointment in the home consulate and go for stamping

She is 3 months pregnant now and need to travel with her husband's coffin to India in another two days. We want to consult with an immigration attorney soon, but before that we dont know what are the aspects we have to consult.
Following are some ex. questions. please provide your input for them..as well as any other missing items we have to consult with the attorney.

When she is in India
1. Will her GC be in valid status. How long can she stay in India without any paper work and return back to US. What are the paper works she need to do before going to India. Can she do the paper works in India itself.
She can be out of country for 5 months and 29 days without a re-entry permit. If she applies for reentry permit she can come back after 1-2 years. She will need to apply reentry permit before she leaves U.S though
2. If she delivers a baby in India, will the baby be a US citizen as the baby's father is a US (became) citizen (like person of american origin).
The newborn will most probably be an Indian citizen. He/She would have been an US citizen if the father was alive and baby was born in India (since father was a U.S citizen). This falls into a gray area and getting a legal opinion might help.
3. Can she claim Social Security benefits from India.
Does her GC status determines the collection of her husband's Social security benefit.
Yes, She can claim social security benefits irrespective of where she is and even if the father does not have 40 credits (though the benefits that can be availed will be low).

This is serious. Did you file 2 I-485's by any chance?
I received an email from USCIS stating my case status to be "DENIAL NOTICE SENT".
It says,

Just to check the status of my 485 I had raised a Service Request in July. This is the reply I got today:
The status of this service request is:
Based on your request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please call customer service at the number provided below.
Does anyone any experience on this reply? Is it a generic reply or hint towards RFE?
