If you invoke AC21 can you still maintain the H1 status? Basically i want to change the employer without affecting my GC Process and also not to fully depend on GC to be in status.

I was told by my attorney that you can transfer your H1 as well. This will help to maintain your H1 as well as your 485 status. I never tried it in my past, but request you to consult with an attorney to reconfirm it.

In responce to SR I received the following reply from USCIS
The Permanent Resident Card cannot be completed because the biometrics have not uploaded into the system. We are looking into the databases to see if the images can be found.
Did anyone received a similar reply?
I gave my fingerprints last thursday (September 4, 2008).

If I were you... I'd do the following:
1. Contact the best attorney possible, irrespective of Cost/price/Fees.
2. Not leave this employer voluntarily.
3. Find another job and if possible work in two places.
Sounds ridiculous that you have to go through crap after getting GC.

Got my GC during September and my sponsor couldnt find a job right now. He is saying, they are going to revoke I-140?. Is this normal?. Will it affect me in any way?. Thanks.

I have the same situation and here is what my lawyer asked me to try.
1. go to the nearest CBP port office with your valid visa petition(I-797), original I94 and employee ment verification and the passport. Fortunately, i was able to get the new -194 based on my valid visa petition from the CBP officer. The issued a new 194 card and modified records in the computer with the new admitted date.
2. If the first option is not working, since your are not passed 180 days limit, you can go out of the country and get your new i94 card. this is how my friend did few months ago. he went to canada and go that fixed.

After that I switched companies and my 797 with new i-94 ( piece of paper attached to the bottom of 797) is valid till 2010. Do I need to leave the country to get the new i-94(White card) or am I ok.
This query totally confused me!

If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
How much time does it take to get this. I am going to be out of country on Nov 4th. will there be any issue If I cannot make it to the finger printing.

As part of Team IV I took ownership of organizing IV professional networking events and had some time carved out this weekend to put some thoughts together on how to do this. We already have a linkedin group for Immigration Voice and I have become a member of this already. I will be glad to work with you on this.

I have been a member of IV for sometime. Over the year i have seen increasingly disheartening posts from people from being abused by their employer to being let go at a critical moment of their GC process where they are left with very little options. The reasons for people seeking jobs within the IV community are many but most of them seem to center around difficulties in H1-B sposorship, GCs, longevity of process, hardships etc. I know that if i was ever in this situation that it would be great if i could use the community's help to get back on my feet if i needed it.
I thought about an idea to create a free Jobs and referral portal to help people in their hour of need. Here are my thoughts & assumptions going in:
1. members of the IV community probably fall under these categories:
a) empowered to hire directly (manager or executive)
b) in a an influencing capacity (reccommend or work with hiring mgr)
c) refer but cannot influence - are aware of job opportunities within their environment that may be difficult to locate in a portal like Dice.
2. members of IV generally work for H1-B and GC friendly companies.
3. Members of IV will be able to give better insight and job prospect opportunities from their enviroment than any job site as they witness the requirement, opportunity, political env, etc first hand to be able to reccommend.
Essentially i want to create a portal where we can match IV job seekers with Job opportunities based on our our hierarchy of influence. we can also think about prioritzing the need based on situation:
1. Lost job & need sponsorship asap
2. Need to be free from terrible employer
3. Just looking for better opportunities with GC friendly companies
4. etc
I am a non-technical person (IT) so I am not even sure on what kind of portal this would be. I am right now looking for feedback from all to know whether this is something that everyone would be interested in, and if so, whether people would be able to contribute some time towards development (at least the techys amongst us).

The dates may even retrogress back to 2005. There are still people from 2005 who are waiting for their GC. And there are people waiting from Jan - Mar 2006. So best, it would move back to early 2006 or late 2005. I am not so sure if USCIS will be able to approve all the cases who are current up until September for the dates to stay the same.

I think that is only applicable if the PERM started after July 2007. For cases where PERM was filed before July 2007 (i.e. before the law change), it is upto Employee and Employer to decide who pays how much.

Check with your employers insurance agent. Agents can provide you information on how to split up coverage to get a better deal.
This will depend on your state as well.
If nothing else works, check with your state insurance board, states run a pool for folks who cant join a big group. Being a part of such big group will get your benefits at a marginal cost than what you are paying now.
From experience, being with a small group(insurance group) its very painful and you end up paying a big chunk.

I am quite certain that my company has negative net assets. Some colleagues close to HR told me that my company might be in debt. This is just hopeless for me now. I have to accept my fate and move on. Maybe I am not destined to stay in the US after all.

Do you mean to suggest carry letter from client and other stuff for employee-employer relations? How about carry client letter submitted with H1b petition as it was filled in recent past. Getting another will be really difficult. Anyway share your thought.

Don't be so rude, All that he wanted to know is the meaning of "Bump" in this context. Just findout by yourself is not the right answer. If he can findout by himself then why should he ask you this?. Even if he found the answer , He would like to double check if his understanding is correct.
