Can you share your Priority Date, category/country of chargeability, Processing Center?
Hello friends - I got a email updated from CRIS today stating that my Notice is mailed welcoming the new permanent resident. The email states:
"On January 16, 2009, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register."
What does this mean? When will I get my approval of my 485 and when will I receive my physical GC?
Also I have done my FP on 31 July, 2007. Do I have to get a new FP done?
Any suggestion or feedback on my queries will be highly appreciated.

What happens is that when dates are advanced forward sometimes more than estimated number of people becomes eligible to be approved.
- If the number of people eligible to be approved is more than the annual quota itself then some out of them will get approved till the quota is finished and the category becomes 'U'.
- However if USCIS / DOS feel at any given point of time that lesser numbers are available then they will move the dates back (Retrogress).
My advice to you is don't worry about all this. Depending on your degree try and find an employer who can file for you at the soonest in the highest category that you can be eligible for. See retrogression is something which is out of ones control, however delay from ones own side is entirely ones own mistake.

I verified my documents and dound out that my PERM labor was filed in April 2006. So, I believe that my date is not current yet. Am I right? SO, I should have atleast a breathing time of one month in my hands.

yes, over a month and a half actually... you are not current in August VB, which means you are ok till the end of August.
I think withdrawing the 485 is the only option. Even if you do get registered marriage right now, if you get approved in September how will you bring your spouse over unless she has own visa (H1-B or L1 would be the only option as B1/F1 would be out)? You can have her file for consular processing in India (you cant do AOS as she presumably wont be here in the US), but then approval of her application cant come until your PD becomes current again... assuming dates retrogress in October as people expect, it could be many more months before you get current again.
Am I right?

I remain an optimist. From what I have researched, it seems that CIR might be taken up in October (if the economy improves, and as we have seen recently, it is starting to cooperate). This is coming for sure, so we have to start getting ready from now!
My question to our forum is, what do you think CIR will look like? From your research and what you might know, from the legal standpoint, are we looking at:
#1 - A points system?
#2 - A change in country caps?
#3 - A combination of #1 and #2?
What do you guys think?

There is a possibility of tightening the EB greencard process and H1bs. Do not be surprised if that happens because there is an effort in that direction. The bad economy is helping such attempts. It would be tough to go in this direction because the industry will oppose that.
What you can see is border enforcement, path to citizenship for undocumented and dream act included in it. This is because we are hearing that CHC is putting lot of pressure for an immigration reform.

I got the RFE document and forwarded it to my Lawyer, he is also Copied into original letter from USCIS. He is the same, my old employer Lawyer who has started my GC . I continued with him for filing AC21. He may be the one who may have invoked my I140 on the behalf of my last employer, but I am not very much sure about it. Is it safe to use him for RFE also or should I use some other Lawyer.
In this perticular case (your prev emp vs. you) your lawyer is a dual agent, so it's obvious he won't share info about his "other" client (your prev emp) with you. But in general if he is providing good service to you ,responds to your questions in a timely manner and provides you enough techinical information, then i'd keep him. if you ever need to provide any info/doc from your prev emp, he is the one who can get it. If you change the lawyer you will close that door. In any case, make sure you have a copy of I-140 approval and also copy of labor approval, if possible.
When my 485 was denied because my prev emp revoked my i140, i had difficult time getting it, my new lawyer fortunately knew the other lawyer and extracted the approval from him and provided it to me.

I remember airlines like british airways ask for a valid visa (or) transit visa.
Any one travelled on the following airlines with EAD/AP without transit visa?

Hi,
My Labor was denied in 6th year. I have my 7th year extension in couple of months.
My employer doesn't give much details of why my labor was denied. When i insisted them the reason for denial they said that they just got a letter saying that they are already US Citizens available with that skill set. I asked them to send a copy of the denial letter but they say that that letter also has other case numbers which they filed and don't want to reveal them. Is that believable?
I said them to file appeal so that the case would be in pending and i can apply for 7th year extension. They said that its an no objection denial and they cannot appeal the case. Can it be true?
Now i am even not sure if they applied for Labor. I need to get some proof from them. For what document can i ask them for this? What should i do in this situation?
If you visited india/your home country in these six years, you can recapture those dates. It might give you couple of months. In the mean time, if your PERM approved you are good. Check with your employer how much they are willing to help.

I spoke to my Lawyer regarding this situation, he said that there is nothing we can do about I140.
Your attorney is right that if employer has withdrawn I-140, one can not do anything. But if it over 180 days since you filed your I-485 (which seems to be the case), this withdrawal should not impact your I-485. I think during the move from NSC to TSC, they may have committed some data entry error.
Just curious how big was your previous employer and what do you do?

Hi I got a job offer from TCS America. Not a great company to work with i guess but given the job market i want to be little conservative.
In the past i heard some bad things about TCS practices and benefits (medical and so). I am not sure if they stay the same or anything has changed. I also heard that they ask for 3 months notice if you choose to leave.
Could please any of you familiar with TCS and their benefits please pass on your comments. I am specially interested to know how professional they are and how their medical insurance work. (I am told the medical insurance is very bad that it doesn't cover much .. is that true?)

Starting a new thread so members can make use of our experience at SAN JOSE.
Post all congratulatory notes in the other thread.
Only suggestions here please:
1) Any placards must have the word LEGAL in big black bold letters. Its very easy to read legal as il-legal when you are driving by in a car....
2) I think its a good idea to pre plan the route so you can choose big side walks... ideally 2 miles round trip is very easy to do-- also print the route map and directions and distribute so organizers wont have to stay in front at all times
3) choose spots where the sidewalk is really big so you can assemble.. at different rendezvous points.
4) ensure that at no point pedestrians are skipping signals..
after we obey every rule there is....
befriend the police... smile at everyone....
other partcipants please add... to this thread...

I second what "gcdreamer05" has mentioned above. Be patient until you get what you wanted and make your move. Tell / find valid ( or make ) reasons where your attorney cant play any more games quoting your employer regarding your I-140 Receipt#. Dont rush and make any urgent moves and jeopardize your valuable that you already have spent towards your GC journey and re-invent again. Who knows how the situation is going to be in future wrt GC process. Good luck. My2c.

I never used my H1-B, I worked for another company using EAD, that voids my H1-B status so I used AP to return.
What do you mean it is not lawful entry ??
For I-485 under employment based category, applicant can avail 245(k). Under this section applicant can adjust status to Permanent Resident as long as out of status since last lawful entry does not exceed 180 calendar days.
For this purpose only, the last entry counts that was made on non-immigrant visa. What was your previous entry with visa? That will be your last lawful entry for I-485 purposes.
Using AP is valid entry, however, it puts the applicant is parolee status.
I suggest that you follow up with your attorney.

This question is flawed. The act of changing employers from your original sponsoring employer means you are automatically invoking AC21. Whether you use H1 transfer or EAD is just your decision on how you prove work authorization to new employer. There is no way you can change employers without invoking AC21.
