    Hi techskill: I have asked this before in this posting to someone else. Was your medical exam complete in all respect? My wife's was not as she was pregnant then. The Doc didn't administer one shot.

    Also to all of us whose files seem to be in the strange NSC Examination room: Yes, the Infopass IO told me that my case is all set. He didn't say if it was deficient in any way. I was just wondering if any of you guys have any such deficiency like medical?

    They would have sent the rfe by this time. Does our PD needs to be current to send an rfe?
    It is USCIS we talking about,even that might happen.

    I hate to be the one to have to make this argument here as I deeply sympathize with everyone who is a potential DREAM Act beneficiary, but there is a logical paradox in this bill that I cannot simply overlook.

    If this bill were to pass and be enacted into law, what would be the next step for some two million undocumented aliens who would benefit from it? Obviosuly documented and legal beneficiaries would be able to drop their visas and embrace a level an unprecedented level of workforce and social mobility previously denied to them. However, I can not with say with confidence that the newly-documented beneficiaries would be able to enjoy the same priviledges.

    Primarily, the cost of obtaining a college education would deter most beneficiaries from being able to fulfill one of the key requirements for full legalization. Just because someone is allowed to go to college does not mean that they would be able to. If you think that college loans will enable your dreams, unfortunately you are sadly mistaken. Current loan underwriting standards are too restrictive to allow someone with zero equity and zero income to secure a loan. College takes years of financial planning for most middle-class american families with a steady annual income well above the national median average. As someone who works in Finance you would have to show me one hell of a model to get me to me to accept the risk of underwriting a loan for someone who has no tax history and no real source of income, only a "DREAM". In-state tuition programs or any federal assistance would put an enormous pressure on the taxpayers and would bankrupt the underlying program funds. As a taxpayer myself I would be furious to know that my taxes are going to fund the education of people who did not equally contribute to the pot to begin with, but are now lining up to reap the benefits of my hard work. Public discontent would quickly halt these lending practices and present newly-legalized beneficiaries with yet another dead end.

    The two-year requirement as it is written into this Bill is a joke as well. If you want to stay and work in the US you need a minimum of a Bachelor's. A 4 year degree is the only way to go, and as I said before, plan to spend close to 200k on a decent diploma. I have been fortunate enough to attend college for free but have friends who have great jobs, paying more than 60-80k and are struggling to make their monthly loan payments which can be in excess of $1500 per month.

    Lastly, this Bill does nothing to solve the problem of the other 10 million undocumented aliens residing in the United States. The beneficiaries of this act would be able to do very little to help their parents, siblings and relatives who would still be stuck without a status. To be honest, I am completely against general amnesty knowing my family's own legal struggles with immigration. It would simply be unfair to the thousands of highly skilled workers and researchers stuck in Visa limbo waiting for their Green Card applications to come current. Allowing illegals to cut infront of them in line would be the equivalent of a school bully cutting you in the lunch line to claim the last cookie. Unfortunately, the only reason there are 10 million undocumented residents living in the United States is labor economics. Due to their status they have to work for less, much less. If they were legalized many of the jobs they currently fill would evaporate as paying a "fair" wage would bankrupt most businesses (landscaping, construction, restaurant) that currently employ these workers. This would leave them in a jobless and furher exacerbate the problem of poverty already plaguing immigrant communities.

    I am not an enemy of the DREAM Act. I support it and I hope that one of you can address my concerns and we can have a civil and fulfilling debate. Look forward to your comments.

    You fill out a portion of the form online. When done, it will generated a PDF with your application number on it. You have to then print it and complete the remaining pages by pen. You also need to complete a "Nationality Status Verification Form". Its on their website. :confused:

    Let's say I switch to another employer using AC21 while waiting for I-485 approval. Then, I-485 is denied due to a simple reason like insufficient funds. Do I have to go through the GC process all over again, or can I just fix the problem and re-file I-485 using the old priority date?

    As per my company lawyer 485 cannot be denied on insufficent funds/ability to pay etc ..this checks is made at I-140 stage.

    As per him 485 can be denied if for health reasons, criminal background reasons or non compatibility of current job with the labor details...does anyone have a different opinion?

    I think there K Visa - Fianc� Visa to come to US. Not sure how it works.

    K visa is only for fiances of U.S citizens. GC holders have not that many options other than under FB immgration quota just like vivekjay explained.

    zamoo - it has always been an issue for GC holders to marry non-U.S citizens as their spouses come under the FB quota whereas the spouses of the U.S citizens don't have quotas and so, their immigration is unrestricted under FB immigration.

    Hi,

    Is there any way for my company to continue my GC processing if I relocate back to India and return to the US when it's approved since the GC is for a future date employment?

    If yes:
    1) How can it be done?
    2) Do I have to be employed by my current company that filed for my I-485 after I relocate back to India?

    My GC has been filed under EB3/India, my PD is March 2006. I've got my EAD & AP (I filed for I-485/EAD/AP on July 2nd like many others), but considering the retrogression levels, it's probably going to take at least another 4-5 years before the I-485 gets approved.

    I would sit back and wait for the RFE to come and not get paranoid about it. I know it is easier said than done.. but what can you do ??

    Since this is for EAD renewal... nothing much can really go wrong... so Do not worry too much about it.

    Good point that you said regarding renewal. Any ideas how many days it is taking these days for these documents to get cleared.

    Hello all - This is my first time. Let me tell all of you that IV is an absolutely wonderful effort.

    SO I am confused after reading this post - I have filed I140 and I485 in July 07. I140 is not yet approved but 180 days will end in February 08. I have a job offer from another company. They are willing to transfer my H1. But I do not want to do that since I will loose my Priority date. BUT if I understnad correctly if I wait till February, I can get a H1 transfer and still keep my original GC application? All I need to do is send the new employment verification letter and change of lawyers?

    Please respond since the new job offer is reaaallly good and I do not want to loose it...

    Even if your 180 days are up you prbly need to wait until your 140 is approved before you transfer your H1. Otherwise you will loose your priority date if you transfer without 140.

    Situation:

    Employer asks employee to sign an agreement before filing PERM. Per the agreement, if the employee resigns between the day it is signed and till one year after Green Card (yes, the real green card) is issued, then the employee has to pay back the legal fees incurred by the employer.

    Question:
    -----------
    What is the legal basis for such an agreement? If the employee really resigns during that period and matter goes to the court of law, what might be the possible direction?

    Does IV has an stand on such situations?

    You should negotiate with your employer. It is OK to discuss with your HR and tell them that currently it is taking several years for obtaining a GC. In some cases it may even end up in decades. You can tell your GC sponsoring employer that you are willing to sign an agreement that has a definate period, say 3 years. Make sure your manager feels that your request is reasonable and take him/her along to meet the HR and discuss.

    As far as i know it is considered normal for someone to change jobs in 3-4 years and move on. Offcourse, i do not mean you tell your HR but it is implied.

    Hi All,

    My priority date is March 2006 in the EB2 category. I am scheduled to be married to an Indian citizen in December 2010. However, based on the visa bulletin, it seems possible that I might get my 485 approved as early as August 2010. What are my options to delay my green card processing until I get married? What other options to I have to bring my wife to USA in case I receive my green card before marriage?

    Any suggestions and advices would be greatly appreciated.

    When we Use AC21 and Join a New Employer after your I-140 is Approved.
    USCIS will NOT Look at the "Ability To Pay" of the future employer.
    This has been Clearly specified in the AC21 Memos.
    You Can google this and read about the Ability To Pay situation.
    I think it is still there on the Murthy's website.

    But they can issue an RFE for the same. This means that they will want to verify the authenticity of the job offer. This is also stated in Murthy FAQs

    The explanation is not given by CIS (of DHS). It is given by the DOS.

    I am working closely with a Fed Agency. So I know their thinking

    1) CIS official did not give in writing, everything is verbal

    2) CIS is trying to protect itself to prevent possible lawsuit as they have requested more visa numbers than what should have been allocated.

    Hi Friends,

    I have a similar situation, where my I94 is getting expired in july'08 due to my passport expires. I have valid visa till sep'09. I got my passport renewed and got new passport. Now I need to extend my I94 either here or go outside USA, like canada for get new I94.

    Please suggest me what needs to be done If I plan to goto canada and come back. How many days do I need to stay in canada to get new I94. Any help is appreciated.
