Contacting Senators or Congressman is very easy. Google it and you will get plenty of links to how to find the congressman of your area or senator of your state. Talk to their staff on phone or you can find some link on their web site suggesting how to contact them. Most of the time, the staff will be very very helpful and they will ask you to fax them your issues and then, u need to follow up with them.

I am not a lawyer, but I can give little information, but it is your respobsibility to check with uscis for 100% correct answer.
If a H1B employee is fired or laid off, employee is paying for the 7 days leave then that seven days are counted in H1B period. For example if you got laid off 1st june then it is counted as he employed official upto 10th june.
Before sending cancellation notice to USCIS the employee's responsibility is to provide the airticket and other expenses. And employer must make sure the H1B holder reached his country. Then submit cancellation documents.
Since it is a big money (ticket + shipping etc.) involved most of the employer never cancel the H1B.
Hope this will help little bit, but your responsibility to check everything 100% from lawyer or USCIS.

Very funny but it is not the answer I was looking for. THe lame duck session finishes some day and that day we will know if they discussed it or not, come on is it so difficult to answer?

That's my understanding. As long as you work fulltime for H1 sponsoring employer and H1 is current, you do not violate terms of your H1.
even my attorney told me that we can use the EAD for part time employment and use the H1B for the primary job, thereby maintain H1B status. did anyone's attorney tell that?

Guys
Despite all but one reasons to the contrary, we decided to use BA. That one reason was price (no surprises here).
We bought the tickets in January and waited till May for the date to come current, so we may travel on GC rather than DATV. As we all know, the date actually went back.
After a little bit of procrastination from both and some reckless assuming from my spouse, we reached a stage where we had a full Wednesday, a full Thursday and a bit of Friday left to apply for the DATV for my spouse from scratch and to get our kid's passport and post-biometrics documentation to the UK consulate and get back both their passports with DATVs.
The reckless assumption was that an approved but unstamped H1B (basically just the I-797 Notice of Action) was good enough to not require a DATV for my spouse.
Besides, we did not read the instructions on the DATV paperwork carefully enough to note that we actually had to Fedex the docs and passport to the consulate. My spouse just went by what the staff at the biometrics center advised, which was that you are done and good to go and basically wait for the visa (even with the kid's passport in our possession)! Yes, that was way dumb on our part.
So we woke up to this in the afternoon of Tuesday and soon had friends sending us information and offers of logistical help. My spouse applied for DATV online that afternoon and secured a Friday appointment for biometrics. That was the earliest available and was also the date of their flight!
Taking a chance, my spouse went to the biometrics center Wednesday morning and managed to get the fingerprinting done by 0815. Then we drove to the UK consulate, hoping they would entertain our case as an emergency.
We might as well have hoped for a date with Rapunzel. It was not ivory but it was a tower alright. My best people skills succeeded in persuading the lone security official downstairs in calling upstairs. However, as per his prediction, all that came down was just another security official who said absolutely nothing different, which in essence was: You are not allowed to go upstairs. They will not entertain ANYone (obviously excludes the President, the Queen and other such people) unless there has been a death (their accent made it sound like the word 'deaf') in your family (and we couldn't think of misusing that for our case). The window opens for visa agents between 0830 and 0930 and since it was already 1030, even a visa agent couldn't do squat that day. Applying directly is only possible through mail and it will take a minimum of 5-10 business days to get the visas. However, here is a list of visa agents with their contact info who might be able to help you get the visas quicker
Meanwhile, a lone visa agent was interacting with my spouse in the same lobby. He was in the printed list given to us and since he was already talking with us, we decided to go with him. He said he was going to charge us $100 per DATV for his fees. We were free to leave our papers and passports with him right then or we could show up at 0830 the next morning for him to take the papers in. We elected to do the former.
This guy then applied for our DATVs on Thursday morning and asked us to come collect them Friday morning (day of the flight), which we did. All went well thereafter and a little bit of carelessness cost us $200, loss of sleep, loss of work-hours but also reassured us that we have some great friends around us.
Here is the whopper though. Noblinkingbody ever ever asked to see these DATVs all the way from US till India! Is this then just a sham for law-abiders? Just emblazon some logicless words in some officious location and amuse yourself watching these worker bees make a line carrying them out at some undeserved expense to themselves?
You know what though! I asked myself if I would still apply for a DATV if required and with all this information in my mind, my answer was an unwavering yes. That's how I fear a lot of us might be made, which is why we continue doing the lawful and the right thing while accepting the step-parental treatment here in this country.
Oh well!
You were probably lucky to not get checked. Several years back I took the German transit visa for Frankfurt and they never checked anything , not even in Dulles airport, they just looked at the boarding pass and let me in(it was never checked at the small airport where I started the journey). However, I know a friend who bought a ticket on Virgin Atlantic from Boston and at the gate they denied boarding to him for lack of transit visa, but they refunded his credit card immediately and he had to call his agent from the airport to get a KLM ticket at much higher price. I think better be safe than sorry.

Sorry if you have done so but can you briefly restate what the goals of iv-physician are? I am a MD PhD (MD from India, PhD from US) in residency currently, on H1B (so no J1 or NIW issues), and havent applied for a GC.....and to me superficially it seems that your issues are geared towards the J1 waiver /NIW community? I may be wrong, but can you elaborate if you have broader goals. Thanks for your time, and for taking up leadership of this community.

My son is a student at UGA starting fall 2008.You can get in state tuition from both colleges(at least we did).After you apply and you are accepted you have to apply for a Waiver.You'll be considered international student with a Waiver for in state tuition.You'll get help from Financial Office for this.

What is the point in introducing a bill if it does not move? There is no urgency for US government or for companies to do immigration bill. 90% of gc waiting people will stay and work hard for US companies. So till 2009 congress may not do anything. For the past 3 years H1b cap was reached but no bill was able to pass thru congress to increase h1b or gc. Even current house speaker will not allow any immigration bill for consideration unless she gets support of many republicans. CIR may be only option to do it in current situation

My collegues who know best working places in US and Europe now also have a liking for Noida, Gurgaum, Bangalore. I know few people who have moved to India after they have been here for some time. They probably would not have done it 4 or 5 years back, but they can now, given the developing atmosphere back at home ,job security and higher pay.
Also refer back one of your old posts where you referred higher exchange rate of RS/$ then as one of the reasons to be in US. It came to 42 today.(Not to mention the gas is near $3 :D ) So I do not think what you said here is right if 90% of people will just hang around for ever and working hard.

My lawyer gave me the DHL tracking number. The package had only my application so I am sure it reached USCIS office. I also took a print out of the delivery and signature of recepient info from DHL website.:D

How many days before the start date on the H-1B approval notice can one go to the US embassy to get the H-1B visa?
The new H-1B approval has a start date of Nov 1, 2008. Can one go on say Oct 15, and enter the US with a new visa before Nov 1st?
Current status is H-1B, expiring on Oct 31, 2008.

Yes, most people get VISA stamp bc of interntaional travel not bc it looks good on ur passport.
why do you want to do that - unless you have international travel plans ahead. even if so - the best bet would be getting it done in india. i dont see that many people were successful in obtaining visa from canada, who dont have masters from USA. my2c.

WOM - Writ of Mandamus
People typically file WOM to make government act on their petitions. Usullay done to expedite the name check process (you have to wait at least 2 years I guess to file :) )
The usual story is DAs office will file a motion to dismiss saying District judge lacks jurisdiction over immigration petitions and attorney general has discrtionary power blah blah.....

Hi,
I have applied my change of status on Jan 25th from F1(Trivalley Univ) to H4. I did recieved my EAC number after 4 weeks. I called USCIS to check the status, They are saying decision is pending. Also they are saying it may take another 3 months.
Is it the same case for other change of status applicants ? or Im the only one having this issue. Is there any way to fasten my process ?
Also for some reason when I check my status online at USCIS website, It says your application cannot be found. I did explained this to USCIS, They say there systems are down. Thye are giving the same explaination from past 3 months. I dont know what going with my file.
Have guys face this kind of issues ? Please share your experience on this.
