can you still stamp the h1b in canada if you have an extension notice?I have heard people do that in the past not so frequently anymore.i don't know why.
Did you mean H1B extension, I got it stamped last november, my friend got it 5 weeks ago, if anything changed after that, I don't know.

It looks like nothing will change anytime soon with the annual cap or regulations related to H-1B or L-1 visas, the temporary visas most commonly used to bring foreign-born tech workers into the U.S. Or will it?
The U.S. Senate Thursday morning failed to pass a motion that would've ended debate and allowed its comprehensive immigration reform legislation to move forward. This is the second time in about a month that the bill failed to get enough votes to move the bill forward.
Washington D.C. insiders say it's unlikely that legislators will try to revive the controversial bill another time prior to the Presidential elections in 2008.
Software & Information Industry Association president Ken Wasch said he was "profoundly disappointed" that Senate action on the immigration bill has once again stalled.
"Without this action, America's high-tech industry will be challenged to find the skilled workers it needs and therefore put at a significant disadvantage to its global competitors," Wasch said.
But while comprehensive immigration reform looks dead for now, some H-1B proponents and opponents still hold out hope that their stand-alone bills that have been introduced in recent months will resurface -- including bills that raise the cap and others that aim to crack down on H-1B employers.
The comprehensive immigration bill and its amendments included provisions to raise the current H-1B cap of 85,000 (which includes 65,000 visas plus and additional 20,000 visa exemptions for foreign students with advanced degrees from U.S. schools) to more than 115,000 and up to 180,000 annually.
However, that bill also featured anti-fraud and anti-abuse provisions that aimed to make it tougher for employers to skirt hiring Americans for IT positions. Some large U.S. based companies, including Oracle and Microsoft, had complained that those provisions would've unduly punished employers already playing by current rules.
Max Gleischman, an immigration policy advisor to Senator Richard Durbin (D-Ill) said that a standalone bi-partisan H-1B and L-1 anti-fraud bill introduced in April by Durbin and Sen. Chuck Grassley (R-Iowa) is currently "still in the Senate judiciary committee which could bring the bill up again."
Meanwhile, technology vendors, which have been lobbying Washington policy makers for several years to raise the H-1B cap, say not all hope is dead on their side either.
Several bi-partisan bills introduced in recent months, including the SKIL bill, to raise the cap are also still potential relief for employers who say they are finding it hard to hire tech talent with very specific degrees and talent.
"As long as Congress is in session and there's a light on in Washington, we'll be making the our concerns for skilled worker relief known," said Robert Hoffman, VP for government affairs at Oracle and co-chair of Compete America, a coalition of tech companies and educators pushing for employer-based immigration reforms, including raising the H-1B cap.
"We're not putting a stop clock on ourselves," Hoffman said.
Even if a standalone bill raising the H-1B cap is unlikely to move forward prior to the presidential election in November 2008, it's possible the cap could be raised as part of an appropriation bill by the end of this year, said Hoffman. That's what happened in 2004 when Congress created the H-1B exemption for 20,000 foreign students who get advanced degrees from U.S. universities, said Hoffman.
"And that happened just before a presidential election, too" he said.
"I think it is too early to tell what will happen," in an e-mail interview with InformationWeek said Ron Hira, assistant professor of public policy on leave from Rochester Institute of Technology and research associate at the Economic Policy Institute.

Here is my case:
7th year H1 extension expring Feb 2008
I-140 approved in 2006
485/EAD/AP notices received 2 week go.
Now the questions are...
1) What is the advantage of getting H1 extension(once I get the EAD) ? Is it worth ?
2) What is the risk of changing employers after 180 days?
3) What if I continue on H1(same employer) even after getting EAD and if 485 denied ?
4) What if I change my employer and 485 denied ?
5) If my 485 denied and Can I stay as long as my H1 expires(same employer) or has to leave the country immediately?
Any answers or other suggestion would be greatly appreciated........

I did quite a bit reasearch, and also reviewed this situation with Few seniors. Infact, I am also in this situation. But not yet approved / denied.
Can you spell out few more details like:
1) When did the Amendment filed and to which center.
2) Is the Amendment 140 Transferred to any other center (like to TSC from NSC).
3) When did u get the denial notice ?
I know,these questions, cannot answer your question. But just wanted to know, how these cases are moving .

My I-140 got approved on June 2007, since my company A merged with another company B and changed its name and Federal Id to B, my current employer B filed an Amendment for my I-140 on July 2007, USCIS denied the amendment saying no LCA was attached while my company's attorney says they did attach the LC documents. Now they filed Motion to Reopen attaching LCA documents on June 2, 2008, given all these I planned to switch to different employer using AC21.
Additional information:
I485 filed on July 2007
Got EAD approved on Sep 2007
Got AP approved
Done fingerprints
1. Would the amendment denial negates my original approved I140?
2. If it is so would it revoke my pending I485 EAD and H-1(as I am already in 7th year extension)?. Note: I did not receive any notification from USCIS regarding revoking I-485, H-1B etc. My current employer says it wont be so because I already have approved I140
3. Would it be adviced to switch to new employer(Law firm from new employer says there wont be any problem since I already have approved I140)
4. Would there be any problem when USCIS starts processing my I485.(My new attorney says my I485 will be based on new employer and my skill set is matching the position they offered)

If you use your AP to enter the country, you can't use your H1-B anymore. You will have to use the EAD for work.
Also, I didn't quite understand why you/your company are filing for a H1-B visa that too premium processing if you are planning to enter on AP?

The average corporate medical premiums are about $1000-1200. Now if your company is charging you a $1000/month, then he is not contributing anything for the medical. Generally, the companies pay about 60-70% of the premium and the balance is paid by employees. So technically, your employer is not doing anything wrong, if you ever agreed with him that you would pay for medical premiums. However, if you did not agree then you have a case that your company does not provide medical and then you can approach companies lilke Blue Cross or Kaiser and find individual plans where you can say, my company does not offer medical plans ( since you are paying all the premium....u do not need to tell all that), so I need medical insurance for me and my family.
Again the medical insurance is a very tricky business. You need to understand the terms called out of pocket expenses, deductibles and copay. All the numbers are calculated in a complex manner by this industry using these various terminologies. I would say check out how all the numbers will add up for the year, for various plans, pick 3-4 plans and run a yearly number using a worst case scenario and then see how much you will land up paying using each plan.
I have a plan with Blue Cross in MI where I pay a premium of $386/month for a family of 4...almost everything is covered. However, office visits are not covered...that is what I pay whenever I go to a doctor. All others are at 70-30 and then I would only pay a max of $2000/year out of pocket and no deductible. This is an old plan which I have been on for the past 3 years and it is good. However, the newer plans like "IC Blue" are slightly more expensive and have higher deductibles and out of pocket expenses. Remember different states have different plans, check the local Blue Cross agent.
After seeing my expenses for the past 3 years I have seen that my deductible, out of pocket and premiums the max I have spent is $550/pm. Anyway as I said earlier the details are in the math and the way things are calculated. I always ask for cash discount when I go to the doctor and I get a 10-15 % off, which offsets some of the office visit costs.
Overall, you and your family will need to be comfortable with the plan. Since it is diff for each family, some may have a sick child, or a sick person where the $1000/pm may be needed. You will be eligible for a 2 year EAD if these conditions are fulfulled:
1) You are applying for RENEWAL of EAD but your application is pending as of June 30th, 2008.
2) Your visa number is unavailaible. Therefore, INDIA, CHINA, ROW(EB3) & MEXICO filers should be eligible as long as the PRIORITY DATES are not current. However, the other filers will get a one year extension.

I know people who got RFE when they submitted letter from their co-worker, this might be in some cases, I am not trying to discourage you if you are doing so, but wanted you to give best shot as you have to answer the RFE. If you have no choice then give a try, meantime try to get your experience on the letter head so that if you get RFE again so that you will be on safeside

I think we are going to do a good job of getting attention and generating the Interest with this rally.
In order to create 'Desire' among the general population when they see pictures of this rally, we need to streamline our message (same message delivered many times) and also generalize it more than our own plight. Our message should be around how much USA is losing in terms of innovation and competitive edge by stifling the EB GC.
We also need to give them a way to 'Act'. In order to give them a chance to support us, we need to provide them a website address that they can go to sign a petition in our favor. It should be provided in all banners etc.
Guys, it's not that difficult to get help from native US citizens. I have many friends here who are 'Americans' and fully understand the GC issue but they don't have a way to support us.
This way we(immigrants) are not alone in this struggle..We have support from a larger portion of the society..
What do you think? If you like the idea and the core team approves it then I can design a message that covers all 4 elements of AIDA...

I think we are going to do a good job of getting attention and generating the Interest with this rally.
In order to create 'Desire' among the general population when they see pictures of this rally, we need to streamline our message (same message delivered many times) and also generalize it more than our own plight. Our message should be around how much USA is losing in terms of innovation and competitive edge by stifling the EB GC.
We also need to give them a way to 'Act'. In order to give them a chance to support us, we need to provide them a website address that they can go to sign a petition in our favor. It should be provided in all banners etc.
Guys, it's not that difficult to get help from native US citizens. I have many friends here who are 'Americans' and fully understand the GC issue but they don't have a way to support us.
This way we(immigrants) are not alone in this struggle..We have support from a larger portion of the society..
What do you think? If you like the idea and the core team approves it then I can design a message that covers all 4 elements of AIDA...
