Kris is correct, Here is the real scenario on my co-workers case who is priority date is not current.
1st RFE Notice - Requested for W2s, Federal Tax Returns, Last six months of pay stubs since his last lawful entry (2005)
2nd RFE Notice - Required an explanation from Employer and Employee why his one of the W2 were less than H1B LCA wage for a specific year and also an evidence the backup the explanatio and additionally all the pay stubs for that year.
In 2005, he took a 10 week vacation due to family emergency that had brought down his total earnings for that year, which is obviously less than LCA wage. Company had sent out a letter stating that he was on unpaid vacation, along with the passport copies (all pages, marked the exit and entry page), copy of the flight ticket, and all the paystubs for year 2005 to prove that he was continously employed. Now, the case is back to pending status.

I seems to have done bigger blunder. I've sent single Check for Both Myself and Spouse....Didn't heard anything back from lawyer...

We are mobilizing law maker meets through State chapters, do please make it to the NJ meet and we can discuss things in detail

If legislators do not want to know what their constituents need before a vote is cast, when are they going to listen? (not that we have a vote to give :( )

In my opinion.....you only require transit visa while coming back to US through London from India (because you don't have a valid visa stamped on your passport). If you are traveling from US to India via London transit visa is not required as AP holders from India have a valid visa (Indian Passport in this case) for their destination country.

HI Folks,
One of my friend told that my name is very popular in IV forums, and thought of checking how good/bad is my name here.
I'm able to read the forum which was in my name, but I couldn't post a reply as it is closed. So I just started a new thread (of course it took 3 hrs to find and understand this forums, coz I'm not a memebre of any forums)
Some one told that I scrwed their application....I don't think so..coz the stamps are all auto programmed and no body can do anything with that, If it happend to you..then you guys are responsable for this...thinking how?
Yes it is computer programmed. So the s/w might have some bugs...now I have to blame u guys.

Since your W2 shows wages less than the prevailing wage and the compony is showing loss, the only other option to explore is look at the companies net assets. You can find this number from the companies tax returns. Your lawyer should be able to access this and if the net assets are greater than or equal to the difference between the actual and proffered wage, then you should be ok.
I am quite certain that my company has negative net assets. Some colleagues close to HR told me that my company might be in debt. This is just hopeless for me now. I have to accept my fate and move on. Maybe I am not destined to stay in the US after all.

This is what I thought would happen.
I fully expect there will be applications that were "documentarily qualified" and had visa numbers allocated to them last week but for which final post-number-allocation approved will follow in the next few coming days.
After all, just because they have the number allocated, doesn't mean that they got around to pushing the final figurative "Case Approved" button. They could theoretically get to that later.
In fact, it wouldn't surprise me if there were quite a few like this. After all, given that they wanted to get all the available numbers before the beginning of July, they could have been as focused during those last couple of days, on getting numbers alloted, as they were on concluding applications for which they had just already received numbers.
Then, with the flow of new applications closed, they could focus on finalizing those remaining with alloted numbers and send out the approval notices.
One question that might be raised is, what constitutes "documentarily qualified" to have received that previous visa number. I suspect EVERYTHING had to be in order, but who knows. I'm curious to know if, for example, anyone with only Fingerprinting outstanding, might be assigned a number. That would change the complexion of things quite a bit for a few filers that are still waiting. I had my FP appointment on June 29th so I'm probably out of luck. But who knows!
Either way, MLS, congrats! You've been waiting a long time. You've earned it.
And I think you message regarding a degree of emotional neutrality, (as much as might reasonably be expected, anyway) is a good message.
People who rant here endlessly about USCIS being 'out to get us' set a cancerous tone that is the result of understandable frustration but does nothing but propogate rumours, negativity and panic.

About 6 engineers left our company in the past 6 months and my boss was not able to find replacements despite aggressive hiring efforts.
So he decided to outsource project verification work of about half a million USD to HCL India.
I should have called these jerks at NPR and should have told them to send some of these so called unemployed engineers over to our company.
When the DOL is repeatedly pointing to the fact that the current unemployment in EEs is below 2% I dont know where these idiots get their numbers from.

It does look like AILA had reduced the speed in filing lawsuit. Initially they were very fast in getting plaintiff etc. Probably they might be searching for valid points in which they are doing lawsuit
OR USCIS is in backdoor or closed door negotiations with it to wrap the matter in such a way that AILF may not have to initiate the law suite at all... And if theory will fly then probably we may hear good news before the end of July.. 3rd week will give us lot of activities .. my assumption.

They may eventually give Citizenship to "illegals". Legals will be in the same dark room as we have been. Thats the situ we are in. There is no respite, though they say its "Comprehensive" immigration reform. Whats your take?

don't worry about I140.
Apply for your PERM .
my 2 cents:
as long as your labour is certified and I140 FILED. you should get an extension of 7th year. I think for this you have sufficient time.
As per my knowledge(?) an extension beyond 6 years is possible ONLY if one of the following is true:
1. You already are on (beyond 6 years) extension then you are eligible for further extension.
2. Your labor IS pending for more than 365 days. (What if the labor is currently approved but was pending for > 365 days before it got approved!)
3. Your I-140 is approved, which will enable you for a 3-year extension.
So anybody, who has an approved PERM labor but not an approved I-140 cannot get an extension beyond 6 years.
Other experts please weigh in.

I guess it is based on with which employer we want to stay when we get GC, if the one who sponsored the GC will be the one with which we want to stay, then my understanding is we dont have to inform USICS in case of Job Change.
also in the case we change employer and want to stay with him after GC approval, then also it is not mandatory to send AC21, but if we dont send it before approval we have to join the employer who sponsored the GC.
my understanding is in case we want to PORT the 485 then only we need to do AC21, otherwise for USCIS we will join the sponsor, that's the reson USICS sends RFE in case sponsor withdraws 140 as he is saying i will not hire.
Please let me know your thoughts...
