I appreciate we are all in queue to have that resident card. Most, if not all amongst us have been fortunate to have an education, travel, find work and a livelihood here in America. However, there are the less fortunate who may not have the opportunities (or the possibilities) The Diversity Lottery program extends that possibility to those less fortunate, restricted in their lives for whatever reason and so on. Giving people an opportunity so they too can have a better future is (one of the) beauty of this land. This also brings more diversity to the land, where people of different backgrouds / origins come together. Personally, I find it all quite fascinating, because I grew up in a multicultural town, where people hardly integrated. Everybody formed their own little �towns�. Anyway, I for one, do not support the removal of this program in its entirety, because I do not believe someone with a Masters (I have one) or a PhD education, should have more privileges (in addition to what's on hand) to folks who may not have any? Anyway, it�s just an opinion.

I have slightly different situation. I have entered into US in Mar 2007 on H1B status at which time my I94 was stamped H1-B and dated until Sep, 09.
During July 2007 Fiasco, I was able to apply 485 and is pending. However, I never used EAD or left the country so far. When my I 94 expires in Sep, 09 should I exit and enter back using AP or since my AOS is pending, I can continue to stay after I 94 expiry.
Any words of advice will be appreciated..

In my case **** sucking gulti (tamil) employer is deducting $300/month for me when in reality I am not covered. They are just sucking it freely. Sigh. I am tired of fighting with them over each & every issue - I strongly believe Karma will take it's course and punish them their dues.
Please don't generalize a problem and scold some one based on race,sex, ethnicity and linguistic basic, this is really a sensitive matter and it may offend someone.

I received the Notice of Action (140) and I sent to Nebraska the 140-485-765 July 30 and they received it July 2.
It was sent to Texas and I got the copy of the Notice of Action today from the lawyer, I guess they will cash the other checks since they change the visa bulletin on July 17...I don't think they will reject the 485 or 765, I am sure they will process at least my 765.

It was interesting to hear that there are about 400K EB cases in queue and about 40-45% of them are EB India, and another 20-25% EB China and EB3 Mexico is becoming large too.
Effectively, the only solution that can prevent years long wait for EB immigrants in the above categories is EB relief and visa recapture. So you can understand how helpful visa recapture of 200K or so visas will be for all of us.
Just keep in mind though that if 200K visa numbers are made available...the 400k backlog will not become 400K - 200K. It does not work that way.
Effectively, the only solution that can prevent years long wait for EB immigrants in the above categories is EB relief and visa recapture. So you can understand how helpful visa recapture of 200K or so visas will be for all of us.
Just keep in mind though that if 200K visa numbers are made available...the 400k backlog will not become 400K - 200K. It does not work that way.

I have a question regarding 140 and PD transfer.
Is it possible to file I-140/I-485 concurrently while applying I-140 and requesting for PD retention? I hope my question is clear. In this case if the PD is ported successfully then the PD will become current.
While you may not be able to file concurrently, you may be able to file semi-concurrently. That is submit 140, wait until you get receipt notice and then submit 485.
(Disclaimer: Consult an attorney or use information at your peril).

Based on several friend's experience as well as personal experience these rules are made by the borad of reagents in the state in GA you will qualify as in state only if you are under I-485 stage which you are. so talk to the bursar office of your school provide the documentation required, you will have to nove fast.
it does not matter if you have been paing taxes for 10 years on H1/4. though sometimes schools do give a waiver on case by case basis.
you will not qualify for federal assistance though.

i am not sure what is the fee for EAD renewal, you can lookit up the USCIS site. but i am sure its a yearly fee, not a one time fee. I know its a couple of hundred dollars, but you can file for renewal your self and i heard its easy. A couple of my friends do it themself every year.
About paying the cost of renewal, i would not worry too much, as i consider it to be cost of doing business here in USA (atleast till we get our GC).

This is only for Germany:
1) If your stamping has expired on your passport, you need Transit visa even if you have an approved petition, no matter which country you are going.
2)If you are going to any other country via Germany other than your home country you need a visa even if the stamp on your passport is not expired.
Meaning: If you have stamped visa which is not expired and if you are going to your home country via Germany you don't need visa.
For you Suman you will have to get your Transit visa
I had been to German consulate in NY last week

almost three years ago....so let me share my experience.
The USCIS will not accept any birth certificates issued by the Indian Embassy in DC. So, please don't spend time, money and effort on this...
If you have a birth certificate with your parents (i.e., if they registered your birth with the appropriate municipal authorities), then arrange to have that sent to you.
If your birth was not registered, then you have to get a certificate to that effect by the municipality (saying something to the effect that a search was done for your birth records...but not found). Then, your parents will have to swear an affidavit...I can give you more details later, if you would like.
But definitely, the USCIS will not accept anything from the embassy for an I-485 application...

That's true. Only citizens of USA can have political views and can express their views. H1B and H4 holders expressing views might not be legal.

3. Transfer the H1, just a copy of H1 approval needed, and I-140 approval notice is not required. The H1 with new company should be for 3 years, as your original approval was for 3 years. No matter how many years you have been on H1 prior to this approval.
Are you sure? I think this applies only if you are within your 6 years of H1. If you are transferring in the 7th year or later, then you will need a copy of the I-140 approval notice. Do you know of anyone who has got a 3 year extension in the 7th year or later without a copy of the I-140?

Absolutely.
There are unfortunate souls like me who have enough experience to qualify for EB2. But, can only file the I-140 under EB3 because USICS does not consider the 3 year Indian degree equivalent to US bachelor degree for EB2.
4 years Bachelors degree with 9 years' experience; money from employer; but time - I don't have any to squander away. Then makes sense to jump to EB2, doesn't it?

In my case the judge actually granted MTD, so you should be prepared for that scenario. If that happens, you can file an appeal with the court of appeals. An attorney will probably ask too much for the appeal process so do it yourself. That's what I went thru. Eventually you'll win.

Company A where i am working as a consultant has offered me a permanent position, Company B is my employer.
Company B is threatening to sue me if i take up the permanent offer at Company A.
Company B is aware of the offer, I have a contract signed with Company B but the contract duration is 2 years, i am on 3 rd year with Company B. I have 3 year extension till 09(with approved I140)
Can Company B get a restraining order(or sue me) to stop me joining Company A?
Can the company B cancel my H1 before me giving the resignation letter?
If Company B apply for H1 cancellation how long will it take?

May be you are right, there is chance USCIS may talking back door with AILA about lawsuit. because the made mistake, they brake the law. USCIS will definitely loose the lawsuit.
