Was your FP appointment a "Code 3"? I managed to get a infopass appointment on Nov 14th(more than 90 days from receipt date) just to be on the safe side. Lets see what happens.
They have 3 types: "Code 1"- fingerprints only
"Code 2"-FP+Picture
"Code 3"- FP+Picture+Signature
Probably USCIS using "Code 1"(from time to time "Code2" cause you're getting older) when you have to do FP again... and again... and again... due to expiration and not gettin' GC still...

Being on H1 and not paid even for 1 day is considered as "Out Of Status". I think you should talk to your employer to pay you back wages and then convert back to H4 to make sure you are in valid status.

I got laid off after I-140 approved from employer A and they promissed me in writing saying that they will not withdraw the approved I-140. I got another offer from employer B on the same location and their immigration layer says that I don't have to re-do the whole process again and directly file my I-485/AOS, is that true?. Your comments are greately appreciated and highly thankful to you.

Hello All,
I am in critical situation advice me ASAP.
I came to USA in June 2007 on H4 Visa Status Valid until Sep 2009.
Got H1B approval and my employer filed for change of status I-797 ( H4-H1B).in the month of MARCH 2008. Got SSN in the month of April 2008.
My employer didn't place me in any of the project and not even pay me anything since 1 yr.
Recently my husband got his H1B Transfer and extended until sep 2011.
When my husband applied for his transfer I didn't apply for H4 as I am on H1-B Status.
Now I came to know that I should not live in US more than 1yr with out any Pay stubs .
So I am Planning to go India and get back to H4 visa.
1. So what are the different scenarios to get the H4 Visa ?
2. Will the US consulate people ask about my H1 payslips and all when I go for H4 Visa stamping?
3. I don't have any payslips anything so will i get H4?
4. Can I make a complaint to INS labor on my employer and keep the complaint safe side when I go to US consulate?
5. Should I mention about my H1-B or just wait until the US consulate people ask about my H1B?
6. When I applying for H4 if the US Consulate people ask me about my H1 like U have H1b valid until 2010, then why do you come for H4 what should I Reply?
Recently I came to know my employer is having few cases pending on his Company and he started a new company B on same address where my company A has exist.

A reputed local channel is producing a documentary on the contributions of the immigrants to the economy and the difficulties they have to face and have to overcome to survive here and Highly Skilled Legal Immigrant group will be one of the three groups they will be focusing on. Pdakwala one of the co founders of IV has been working with the channel to make sure that there is coverage of the challenges we the Highly Skilled Legal Immigrants are facing due to the present outdated immigration process.
My wife and me both Highly Skilled Legal Immigrants will be a part of this documentary. What I intend to do is ....to send a detailed document to the producers mentioning three points so that they have a clear understanding of the contributions we make and the issues we are facing
1. The economic and cultural contributions the HSLI's make.
2. The Competitive advantage this country will lose if it does not make immediate amendments to the broken Immigration process.

I am not sure you understand the big picture, my friend...perhaps you are in the habit of reading selectively!
Business HIRES you for your skills, but the country LETS YOU IN as a permanent resident not only for your skills! Mind you, your company doesn't grant you the right to stay here in this country. The government grants you the right. THE US also has to consider how many people it is letting in from your country. As I understand it, Congress (yes, they still make the laws, not the board of directors of your company, which I am sure must lobby, but doesnt't quite get to enact legislation in Congress) wants to keep a balance of immigration from a wide spectrum of countries.
Business may sponsor you for a green card, but it doesn't LET YOU In to the country. The nation has designated the USCIS to do that and the USCIS does based on the laws that Congress makes. What part of this ain't clear to ya?
Have a drink or something, and then chew on that one! Cheers!

I dont see a big problem , yes there is a problem because you lost the job . Here is my adivce there are 2 things you should be most woried about , your financial condition and health insurance(very important as your wife is pregnant).
About your job and your status , you are ok as long as you find a new job and as your are open all over US , you can find one easily.

Look around, Shout loud in this forum. You will find 500+, may be 5000+ like you. We are all suffering due to this nonsense. I would say just stay cool and calm and stretch for few more months. I know this will sound odd but believe me it is wise.
Well, its come that time where I am frustrated and fed up with my job and ready for a change. I am however, feeling rather trapped by this process and lost as I don't even know where I am in it. Maybe someone can give me some advice.
I have filed everything through a lawyer, who I feel works more for my employer than for me as that is who pays the fees. My I-140 was filed i'm guessing around April/May of 2007. I recently asked if that was approved, but apparently that is privelaged information i'm not entitled to. My receipt for my I-485 is Sept 2007 and I am currently working off an EAD, my second one which I recieved this past September.
I NEED to change jobs. I can not, and will not, stay at a place that I am miserable at. I just have no clue how to go about it. I already have a lawyer, but as I said, I feel they work more for the employer than me, and so I am hesitant and mentioning a change of employers for fear that will get back to my current employer. Would it be wise to find my own lawyer? My I-485 has been pending for well over 180 days, but it appears the key to being able to use the AC 21 portibility is to have your I-140 approved, and how am I supposed to be SURE that is approved if my lawyer is not willing to share that information? I just had my physical done. The only vaccinations required are the ones for MMR and polio. Other immunizations are recommended, not required, I was told. Plus, you also need to get your blood tested for TB (followed with the chest X-ray if the test is +ve), HIV, and Syphilis.

Do you think this would affect those on EAD as well? Does it mean that those of us with approved EAD should switch back to H-1 B to be safe?
