May be you are right, there is chance USCIS may talking back door with AILA about lawsuit. because the made mistake, they brake the law. USCIS will definitely loose the lawsuit.

send emails to AILA on this. ask them about lawsuit status.

Hi

It's always better to get an advice from another attorney and do your home work thoroughly before filing your GC. My personal experience is my lawyer filed GC under EB2 with US Master degree showing NO experience when filing my PERM.

i called the congressman's office and asked to meet him when he is next in town.

the response i got is "send a letter", "he is very busy", "we know your situation". i said i would like to represent a group of immigrants, same answer - "this issue has been taken up by the congress".

"sahab ghar pe nahin hain" attitude.

We are mobilizing law maker meets through State chapters, do please make it to the NJ meet and we can discuss things in detail

Appreciate all the responses guys. Guess i havent explained it better.

Company A sponsored my GC. During labour i went to company B worked for them till now. Went to India and got my GC while i was there. Cameback to the states with green card ( Company B H1B expired ). Currently no project with either Company A or B.

I have told my intention to the Company A to work for them. They are saying, its been a month and they have to inform immigration that they couldnt fulful the I-140 committment. They are saying its just a procedure.

I am in the same boat. My wife's EAD expires 24-Jul-2010. E-Filed on May 24th, 2010. Recieved the reciept notice on Mya 28th. No updates so far.

We are worried..Any suggestions to exepedite EAD processing from IV will be helpful..
In my experience, unless the application is pending for 90 days or more, there is no solution available. My wife had a similar situation in March 2007, when she had applied for EAD through OPT. We went for Infopass appointment to see if it can be expedited, as she had a pending job offer. They took her finger print and photo etc, but it finally did not come in less than 90 days. In the meanwhile she had to forgo the offer, and just two weeks later, she got the EAD.

Cant you get H1 transfer and still work for the other employer?

i still think it's best to apply for ead so you can work for another company if you plan to change job after 180 days. your h1 visa only allows you to work for the sponsoring company. just my opinion.

My I-140 was approved in 2004, my case has been processed completely in california and now its been transferred to Lincoln, NE. I received the email today for me and all my family members.

EB3

Nov 2002 priority date
3rd EAD and AP.
All 485s, even if the 140 has been approved, will be gradually transferred to Nebraska or Texas. It is a part of the so-called "bi-specialization."

One of my friend was in same situation as you are in now.since he droped out from school from second semister he completed 6 courses (18 credit hr),after he worked in H1 for 2 years he againg joined the same school for an MBA program and he managed to transfer some credit hours from previous courses,he enrolled in most of the online courses offered by the school and finished his MS.

Here is what he experienced at the time of Stamping.

1) Why did you left the school from second semister?

He said he got the nice job offer which he can not turn down

2) Why did he go back to school after two years

He said that he needed the MBA at his current working company to move on to better position.

He got his visa after the W2 and pay stubs verified by the counsler (latest 5 stubs)

But My problem is my school does not offer any courses online and my work place is almost 4 hours drive from my school.....

If i enroll back in school through open university and take courses that counts towards my graduation will that help in convincing the Visa officer that I have not abandoned my intent to earn my masters degree....

I cant wait till i complete the remaining courses... any one else to share any ideas or experience...

ivorycard i had a long discussion with the IRS on it, you are right that one cannot have a S-Corp if not a resident, but there are 2 ways you can be a resident, green card status and another way is substantial presence test, so if you are on EAD card more than 183 days in the current year, you can pertty much have a S-Corp and this comes directly from IRS so I assume this is genuine.

I had the similar situation.Called the USCIS no and asked to expedite based on medical emergency in India.They opened a SR and gave me the no.Didn't give any proof of emergency and they told me that if needed they will ask for it.Meanwhile I asked the doc in india to send me the letter for the emergency.I also contacted the senator office.Next day My status changed approved(AP).Got the physical AP in 6 days.

I have a query, Maybe some of the experts here can help me out.

My H1 visa has expired but I have a valid I-797A with my H-1 petition, applied by my employer at the time of extension.

I am travelling to India from Newark, New York via FrankFurt on Lufthansa.

Do I need to have a transit visa ?

Suman, you dont need transit visa. Send an email to the German consulate explaining your position they will confirm back. They are very good at replying to emails.

I went to India thru Frankfurt this October on an expired H1 B Visa and approved I-797 i didnt need a transit visa. I have a pdf document from the German embassy confirming that ppl with approved I-797 going back to the country of origin doesnt need Transit visa.

Appu, can't you ask your HR to process the H1B extension with premium processing ? with premium process your H1b should be approved at least in 2 weeks.

I did my extension at the very last minute too, my H1b expired on Feb24 and my lawyer and I just finished all the paperwork and submit the extension online on Feb16. Got the receipt the same day and the case was approved on Feb22

If the USCIS does not adjudicate (approve or deny) the EAD application within 90 days (within 30 days for an asylum applicant), the applicant may request an interim EAD. The applicant may make the interim EAD request at a local USCIS office. The local office then will contact the Vermont Service Center (VSC). The VSC will review the application and try to adjudicate the initial EAD application, and avoid the need for an interim EAD. If they cannot complete the initial application, they can issue an interim EAD.

The alien applicant must go to the local USCIS district office with proof of identity and any documents that the USCIS has sent the applicant in regards to the employment authorization application.
