Can we request DHS secretary to allow filing AOS even though PD's are not current?
I think we can easily convince them.
People who filed their labor after July 2007 will definitely come forward -HOPEFULLY!

Get your new employer to file a new labor using the Jan04 labor date.
And if your current employer withdraws your 140, it is okay as it is more than 180 days since filing your 485. your PD is locked for your own use.
These are the steps I would suggest.
1. Apply AC21 to move to new employer.
2. Apply new labor in EB2 using EB3 PD.
3. After your 140 is approved, move the existing 485 from your EB3 to EB2.
that way, you get to lock in your 485 application date too. Remember that 485 applications are processed in the order they were filed, provided the PD is curret.
So for example, if a person with PD of June 2004 applied on July 2007 and a person with June 2005 applied on June 2007, the person who applied in June 2007 gets processed first. This logic is true only if the current date is June 2005 or later. If the current date is May 2005, then the person with June 2005 does not get their application processed as the date is not current.

Contacting Senators or Congressman is very easy. Google it and you will get plenty of links to how to find the congressman of your area or senator of your state. Talk to their staff on phone or you can find some link on their web site suggesting how to contact them. Most of the time, the staff will be very very helpful and they will ask you to fax them your issues and then, u need to follow up with them.

I've been speaking with her staffers for about 10 days now. They hear our questions and complaints, but not our thanks -- so please do call either the DC office to let them know how you feel. They will probably take the comment or transfer you to the House Immig Subcommittee office.
As for the House Immigration Subcommittee -- Lofgren worked with the counsel to this subcommittee to come up with the questions sent to DHS. She sent the letter in her capacity as Chair of the Subcommittee. So the committee is fully involved as well.

Sobers, thanks for mentioning that, with immigration bill expected in March, it is expected that the fight will go on until June/July. All of us might have to open our Wallets again as projected expenses stands at $200,000 now

My wife got driving license without road test and I got it with road test around 6 years back. When I asked the difference officer told me that if you have a foreign country license and pass the written test in first attempt then you will get DL without road test, but if you fail written first time then you got to give road test. I don't know how true it is but I failed my first written attempt. (I was a bit over confident that I was driving in India for last 9 years and I can't go wrong and fail). Where as my wife just practiced it on this site N' number of times.
Free Online Written Exam : Safety First Driving School (http://www.safetyfirstdriving.com/exam.shtml) and cleared it in first attempt.
Interesting thing is that in written test chances are you will get almost same questions from what you do while practicing it. Good luck.

My MIL's extension of stay was denied in Apr 2008, while her actual I-94 expired in Jan.
I have done quite a bit of research on this one. I personally wrote letters to the American Consulate in Mumbai, the CBP officers in the US, and even talked to the POE officers at the port of entry where my MIL was planning on entering. All of them confirmed that one could come back after the denial provided he/she left within a reasonable amount of time after the denial. I specifically asked all of them about the applicability of 222 g, they assured me not to worry. American Consulate confirmed that my MIL's visa is still valid and is not revoked. My MIL left within hours of the denial email.
When I called up nearest POE, an officer looked up my MIL's immigration records and confirmed that as long as she pans on keeping her visits short, she is welcome to visit again without requiring another visa.
With email trail of my conversation with the CBP officers, and assurance from the POE officers, my MIL visited us here in the US last year, stayed with us for around 5 1/2 months and went back recently. She did not face any questions at the POE when she entered.
So, in general, it might be ok to come back after a denial of extension. I would call your intended POE and ask them if your parents/relatives could come back.
with recent happenings, I would avoid Newark though. ;-)

Regardless of one using AC21 or not, CBP officer can ask the same question and harass if they want. There is no law to begin with that defines that you have to be working for the petitioner when one is filing for AOS or any stage of GC process. GC based on employment is for "future" employment.
Ethically it makes sense to work for the employer who you will be working on a "long" term project and who wants you to get permanent residency. There is no agreement or obligation that restricts employee to reject the employment in the future or employee to not return and that in eyes of CBP officers is a FRAUD.
I have read blogs where people write that they were told to sit for 2-3 hours before they returned the stamped document and same question was asked them and it took them 2-3 hours to figure out whether to let those guys in or deport them.
On the positive note, they can not deport you because you are not working for the original petitioner.

Hey there,
I'm going through all that right now. I went to the Driver's License place last Wednesday and it was a pretty bad experience.
My license expires on 10/6 and my EAD on 11/5. But I already received my new EAD that expires on Nov 2012, so I was hoping that they would give me a new license good until Nov 2012 instead of 11/5/10.
So I hand both EAD cards to the woman behind the counter and she tells me they can't use the newer card because it's doesn't start until 11/5, which is ridiculous... so she tells me that I have to use my current, soon to expire EAD and then they will give me a license valid til 11/5. Then I would have to go and renew again using my new EAD. SO annoying. So she tells me to sit down that they are running my name on the computer. After a while she leaves the counter and tells me some other woman will call my name shortly.
After 20 minutes, this new lady calls my name and I have to go through the whole explanation again, and she ends up telling me that I should wait til 11/5 to renew my license. So I ask her, what am I supposed to do between 10/6 (my license exp date) and 11/5? She tells me she doesn't know, to just wait! I ask her if I"m supposed to be driving ilegally to go to work and she tells me she's not saying that I should drive. At that point I'm very upset and I tell her that there must be someone in that building that would know what to do with my case and she says she's the manager!!! Then she says that if she enters my new EAD on the System, that it would be rejected and that I would have to wait 30 days to try to reapply (???). So I told her to run my current EAD instead and she told me the system couldn't validate it either (ARGH!). Obviously, she wouldnt know (or tell me) why neither EAD cards would verify on the computer and gave me a SAVE paper telling me to come back and check again in a week.
So in a couple of days I'll be going back and see how it all continues.

My guess is EB2 & EB3 will be U for rest of the year.
EB2 and EB3 are the same. I would recommend EB3-I to port to EB2-I when the EB2 dates moves ahead. So basically, there won't be any good news for EB2 for a long time.

Write a strong Invitation letter saying that there is a chance of you going back to India for Good and its your wish to show your parents USA Once.
And also let your parents say the same reason at consulate.
Also take a letter from you employer saying that you are planning to get your parents here for Tourism purpose only.
Ask them to show all properties bank account and your property in India and let they say when my children are planning to come back what we will do there. I,e there main intention is tourism and spend time with there son/daughter. If they have grandson/daughter also they can specify. (for questions like what is the guarantee that they will come back)
Some times consulate gives high value for such letters and answers.
Try till you succeed. Just keep encouraging your parents. I know this is frustrating but no other go.

I missed 90 day mark. I send my application to Dallas Lockout but they forwarded to Nebraska Service Center .
Here are my details.
I-485 Filed in 2007
EAD renewal - third time
Current EAD Expires - Aug 3, 2010
Receipt Date - May 26, 2010
Checq cashed & received receipt notice
I checked the status on the USICS & it shows intital stage. I am worried , it will not be apporved before Aug3rd .
Any one in simiar situation & have any plans to request to USCIS to expedite our cases

Well, i'll let you know if i get rejected there, homes. If I knew that was the case, then I'd do it anyways. i won't let this country hold me hostage. It's not a big deal. So what if you go to canada for 3 days.... sheesh. Do you know how many Canadians immigrating to the US criss-cross the border everyday? It's a boatload. They have business on both sides, meetings, etc. No Canadian would get a GC if that were the case.
Just because you got admitted in to US doesn't mean a thing as far as GC processing is concerned. I wouldn't risk it.
