With all the opposition that all the immigration bills are facing, I see little light for them. But how about we call the offices and request them just to end the 'country limit' on Employment based Green Card. Let the Employment Based Green Card be given thru a Fair system and that should be FIFO, when there is no quota on the number of people that enters the country for employment, it is unfair to have a Country Quota for Green Cards. If they can come up with a 5 Line Bill for this, this bill will have least opposition...

I had chicken pox when i was a child they still checked my blood for antigen levels and my levels came to be 1.03 and 1.09 is acceptable. They insist I need to take the vaccine, but I cannot take it since I am pregnant. So basically this whole medical thing is a doctor to doctor thing they don't follow any rules.
My doctor asked me if I had chicken pox during my child hood. I said yes, so Varicella is not required.
If I say no, the it is required.
Which means that if you get in your childhood then you won't get it again. Thats what my doctor said. Please check with your doctor.

ONE SMALL INCIDENT WILL CHANGE OUR FATE. CAN WE DARE???
Hi
after seeing this saga for last 2 years, i came to the above conclusion.
We have to do some thing to get the whole nation attention.
It will be very small task for citezens/gc holders.
Can we take their help to get nation attraction.
We can do the following decent things to get the whole nation attraction.
Resources: Placards, display material, aprons shows that we belong to non-immigrants coomunity
1) 1 to 2 days display about our problems in washington, near to senate/house/white house, with our aprons
(Placards, small tent is part of teh play)
2) One day absence from the work
3) Blood donation camps by all teh non immigrants, with our aprons
4) CIty clean programs by all teh npn immigrants, with our aprons
5) Participate in some community programs to help poor/old/childs, with our aprons
Any takers to do this small thing.
Ofcourse it shd be done in teh lead of citegens/GC holders.
As H1 's can definitely not do it.
Wah kya khayaal hai, Kahaan se yeh dimaag me aata hai.
You have seen all the illegals protesting last year and nothing happened and you believe that we few people get onto the streets and protests would make a difference.
Many citizens dont even care of any law that would make people like us become permanent residents. They dont even know their constitution and you want to go and teach them about EB visas and H1-B.
Many indians that I know who got their greencards in 2001-2002 don;t even
care to put a an eye on this issue.. They don't know how many H1-B as being issued, how fast the quota is filled up.
Bhai mere .. let IV handle it and work with IV.

I had looked in to this about 6 months ago when I was up for an extension. Research showed certain pieces of the fees could be paid by the employee and still be legit. My employer ended up picking up the entire tab so did not have to pay anything. On a side note I did have a visit from uscis sleuths after the renewal and they did ask me who paid for the petition myself or the employer. just my two cents!

What I meant was if right now you and your employer together are paying $800/month, it'll be your responsibility to pay it in full once you switch your job. The previous employer doesn't have an obligation to pay his part once you're off his books.

Yesterday I called insurnace company and asked about COBRA and she said contact your employer.
It is a desi employer and I have not yet given a termination notice yet and would not know if he helps in using COBRA.
So how do I go about, please suggest
Thanks in advance

Did you see any LUD's change on your I 485 application since your lawyer sent the new G28? that could confirm that USCIS has touched your application.

if we IV'ers band together to form our own companies.
Not only will we be able to free ourselves from Consulting companies but also dramatically increase our income and perhaps also use part of the revenue to fund IV's GC objectives. Sort of like a hybrid Venture-Captial-incubator/co-op/lobby group. There must be a precendence somewhere....
Think about it. It's not impossible.
Now with more ppl in 485/EAD limbo there's a huge opportunity to do something like this. The only thing we need are trustworthy/reliable GC/citizens (perhaps ex-IVers?) to solve some minor "legal dillemas".

almost three years ago....so let me share my experience.
The USCIS will not accept any birth certificates issued by the Indian Embassy in DC. So, please don't spend time, money and effort on this...
If you have a birth certificate with your parents (i.e., if they registered your birth with the appropriate municipal authorities), then arrange to have that sent to you.
If your birth was not registered, then you have to get a certificate to that effect by the municipality (saying something to the effect that a search was done for your birth records...but not found). Then, your parents will have to swear an affidavit...I can give you more details later, if you would like.
But definitely, the USCIS will not accept anything from the embassy for an I-485 application...

Thank you...Appreciate your response
Mine took 5 business days to arrive. Both lawyer & myself received copies of RFE. It has a golden paper with Immigration officer # incharge of your case. You need to include this paper on top of your response while mailing back so that the papers reach the officer.
For paystubs BC and other queries they give you 30 days but the catch is the 30 day counter starts from day you receive e-mail so by the time you receive the letter with what is needed you have already lost 5-7 days.

Yes, there will be a push for it soon and as IV we all should decide which side we're on as a policy.
I agree with what BimmerFan says. quick reply... will send in a more detailed reply tonight.
Dream beneficiaries should ideally join the end of EB queues. As BimmerFan said 2-4 million kids would be eligible for college legally, but it shouldn't be at the cost of tax payers giving them free education. They are not going to get loans. Even I've been putting off my MBA for 2 years because as an I-140 I don't get loans to pay 50K/year.
Even if the govt decides to give them free education, it doesn't make them the brainiest.
A better way to increase graduates is a world wide SAT which is a better test than jumping fences and dehydration.
A school/college bill for a group that has more than 50% school drop out rate and 10% teen pregnancy rate. WTF? Is that why the graduation clause is removed. VERY CLEVER!!!
What happens with just enrolling for 2 years instead of completing the course? They could get a GC even without paying the entire fee and skipping all classes. But the bigger part is, they can sponsor their illegal parents, brother, sister, husband even in a foreign country. Their kids are already granted amnesty.
Also Dream should ideally allocate GCs to only graduates that the country is short of.
So you see its not even really about college or education, nobody cares, its just a smoke screen, deception.
Its just another clandestine way to get mass amnesty/legal status.
"labor economics. Due to their status they have to work for less, much less. If they were legalized many of the jobs they currently fill would evaporate as paying a "fair" wage would bankrupt most businesses"
This is very true, thats why I said amnesty won't work. Also 3 million were granted amnesty in 1986 and our long term agriculture is only 800,000, and we're still short of farm workers???
Annual budget expenses - social security 700 billion, welfare 350 billion, unemployment 200 billion
All new immigrants should be scrubbed off un-productive free-loaders, who add to this $ 1 Trillion bill.
Dream should give VISAS not greencards. This is all political propoganda by Democrats and left wing Republicans.

Utterly disappointing
Why not write to the Senator's office - make them aware of your disappointment and frustrations. Robert P. Casey Jr. | United States Senator for Pennsylvania: Contact (http://casey.senate.gov/contact/) I am not from PA, so whatever I write will not be taken seriously.
If legislators do not want to know what their constituents need before a vote is cast, when are they going to listen? (not that we have a vote to give :( )

Hi,
Long time reader of the forum, first post. My mother is very ill and she is in India and I need to go to India soon. Here is the situation, My wife is on H1b and I am on H4. We have not left the country so we don't have visa stamps in our passports. We both have the I-797 approval notices. Mine was f1 to h4 after we got married.
Now can I go to Canada and get my H4 stamping done instead of India, I feel there is a better chance in Canada than India. Does my wife (principal applicant) needs to have her H1 stamped on her passport. If I need to do it in India, what documents do I need, do I have to go the consulate or I can come to USA and at the Port of entry they will stamp.
Please advise

All who are still waiting to get approved in the last quater of 2010 please vote on this poll. Also, a humble request to all who are approved and still visiting IV please vote so that we can compare this with the "2010 last quater approval" thread to see who all are waiting and what is the approval success rate. Ideally this poll should have more votes than the "2010 last quater approval". Right niow that is not the case, so please provide the votes....

I am writing these posts for the benefit of many who might not know how the legislative system works in the USA. I was in the same boat till some time ago and am happy to pass on what I learnt.
If you believe that I have made any factual errors, please reply to this thread and I will modify the information here
What does Congress, Senate and House mean?
The Congress, which is divided into two chambers, a Senate and a House of Representatives.
The Senate is composed of two members from each state as provided by the Constitution. Its current membership is 100.
Membership in the House is based on each state's population, and its size is therefore not specified in the Constitution. Its current membership is fixed by statute at 435.
More information about the houses can be found here
http://en.wikipedia.org/wiki/Government_of_the_United_States#Legislative_branch
How can a bill be introduced in the house?
An excellent reference for this is this article again at wikipedia http://en.wikipedia.org/wiki/Bill_(proposed_law)
In a nutshell, any member of Congress (House and Senate) can introduce a bill in the Congress. If its a house bill, it has a number like HR.4437 or if its a senate bill, it is given a number like S.1932. Once a bill passes one chamber, it has to be approved by the other chamber too. The other chamber need not pass the exact same bill. If modifications are made to the bill in the second chamber before passing it, the bill now has to go through a conference committee made up of a few members of both the houses that negotiate to come up with a common bill and then this is sent to both the houses for a vote . If it passes in both houses, it is sent to the President for his signature.
Does a bill become a law once it is signed by the President?
(Updated courtesy of H1B-GC)
Once the President signs the bill, it is printed in the Federal Register and 90 days after it is printed, it becomes a law (United State Code). An excellent reference for the whole process can be found here
