I have heard from a couple of folks that they have met some senior senetors like Bob Dole and have influnced INS to speed up their case of GC processing. Is this true ? .
If this is true is there a way to stop the influence by senetors so that these everyone gets a fair chance of getting their GC.

I spoke to an IO at the TSC a couple of weeks back when my PD became current. I had called to check the status of my application ...the IO mentioned that my namecheck was pending so my case wouldn't be adjudicated. However, the IO mentioned that because of a "pilot program" my case could be adjudicated if my namecheck was clear. I quizzed the IO further, she stated that only applications with current PD are considered for this "pilot program" where 140 and 485 are adjudicated together.
I gather the impression after talking to the IO that I-140 applicants whose PD is not current is not hurt or delayed by the PPP, instead applicants whose PD is current tend to benefit from this program.
Then why do we still have July EB3 still waiting for i-140 approvals? Gurus pls help

lets all get to work and become active in our state chapters to meet lawmakers. If your state chapter is not active, activate it yourself. If nobody is helping you, do it alone. Others will join you when they see someone working. Just sitting back and speculating on bulletins will not help this cause. If you are relying on visa bulletins to save you for the next several months, then you will be disappointed.

Hi All,
My previous employer just called me and informed about revoking I-140. I have been working for a new employer for the past one year and did not invoke AC21 .
Would there be any complications in invoking AC21 now, where as it should have been done last year ?
Concurrently applied I-140 and 1485 in 2007, currently working on EAD /AP.

Get your new employer to file a new labor using the Jan04 labor date.
And if your current employer withdraws your 140, it is okay as it is more than 180 days since filing your 485. your PD is locked for your own use.
These are the steps I would suggest.
1. Apply AC21 to move to new employer.
2. Apply new labor in EB2 using EB3 PD.
3. After your 140 is approved, move the existing 485 from your EB3 to EB2.
that way, you get to lock in your 485 application date too. Remember that 485 applications are processed in the order they were filed, provided the PD is curret.
So for example, if a person with PD of June 2004 applied on July 2007 and a person with June 2005 applied on June 2007, the person who applied in June 2007 gets processed first. This logic is true only if the current date is June 2005 or later. If the current date is May 2005, then the person with June 2005 does not get their application processed as the date is not current.
My PD is Jan04 for EB3 India and its severely retrogressed. I wasn't available for EB2 filing at that time.
Now my current employer can not file my GC in EB2 and use the same Priority date as all the experience is in the current company.
Now if I change employers and new employer files my GC in EB2, can my same priority date be used for the new GC? My I140 is approved and I485 was filed in July 07.
Can there be any problems if I go this route, can my current employer revoke my I140 before my I140 is filed for new EB2 GC? Or is it a safe bet to go this route and get GC faster because if my same PD is kept in EB2 it will be current as soon as I140 is filed.

June 2009 Bulletin is already old news. Lets start predicting for July 2009. I'm bored.
See the problem of being in EB2 India, you have to keep on guessing each month ... in EB3, there is no guessing game at least in this FY (may be in future too).

It's OK. Just trying to understand how it happened. I don't know what will happen if application will be returned after Aug 16th.
Just think, Guys are getting application back after 40/50 days because date is stamped June 29th in application inplace of July 2nd. Per June Visa Bulettine, He/She is not eligible to file on June 29th.
Someone named INSpector ( I like the name) is visiting me 2morrow. Happy to see u man...OK MY job is Just to receive and sign the packets and distrubute to the persons (which computers assign) thats It I can't do nothing more then that.
I'm not Joining in any rallyes....Just to know whats going on here...Yes USCIS suing advanced s/w for everything. Work easy...not work hard

Hello, I am an Indian working in US for 2 years, I am on H1B visa now. before that I did my Masters in US. I did not applied for Green card yet. Actually I am going to marry a Russian girl in 6 months time. I want to know if I can apply for Green card under her name after our marriage. (can I do that?) Because I heard that getting Green cards for Indians takes lot of time. If I apply for Green card after she comes to US, then do we both get green card soon? I am not familiar with the green card rules yet. Any advice will be appreciated. Thanks a lot. :)
If u r serious to get the GC, don't even imagine to apply urself as Indian...u will almost never going to get it unless u r ok to wait for 10-15 years. Its no brainer to understand that if u apply through ur wife, u will not only get the GC but will get sooner.

We dont fill the I-140 # in I-485. Employer / attorney attaches the document. If that was the case we wouldnt have to worry much.

When I called them on phone a nice polite lady took the phone and said my case is pending in name check since my receipt date needs to pass the 30 days they cannot do anything with my I-485. Once the processing dates reaches August then my case will be assigned to an officer and because of the 180 days rule on name check the office may skip my name check and may assign me a visa.
Info pass Experience.
The officer spoke very politely and said my name check is stuck I need to wait for Feb 2009 to hear anything about my name check. I took the 180 days memorandum Name check rule and showed her. She told they cannot follow that because the FBI has given them the time frame to process all the pending name check waiting for more than 180 days on FEB 2007. My name check is initiated in the mid of October 2007 which is almost 10 months.
Now whom should I really on Info pass or Phone call?
My case is pending in the Texas.

This seems to be a common issue when I140 is revoked by previous employer. I think there was an IV campaign about it 2 years ago and some people benefited from it. Check the archives to see if you can get information. We also have free attorney conference calls. You can talk to the attorney about it in the call. Do you have your own attorney?

My lawyer asked me to mail again with a cover letter saying that since my checks were not cashed even after 60 days I am mailing again. I asked the clerk to ignore the new application if they see my original application by the time they open this.
IMHO, this is INSANE. No wonder, USCIS is going to take FOREVER to even issue receipt notices. A concerning mistake on original submission is one story but to reapply just because no receipt was issued is another!

Well they reject that....their explanation is "So you are going to the US to baby sit?". Not a good idea because I know of atleast 2 cases where the visa was rejected with this explanation.
