Hello:confused:
My previous company is refusing to give me a official experience letter..even though i worked there for three years..
I am ready to file for my 140 and my attorney initially said that two Notarized affidavits from employees at the firm who worked with me will be good enough..
now he is saying he is not sure if USCIS will accept those affidavits...
has anyone used such affidavits to prove their experience.?did it work
Will USCIS reject 140 because of this or will they issue an RFE...
can i send the h1 approval that i had with that company as a proof of working.
gurus..plz advice..
NSC approved mine.
I had notarized affidavits from my manager. I also submitted my offer letter and last paystub to prove my working days in that company.

I finished my 6 month period and was planning to move on AC21 to a different company and the employer is threatening me that he would withdraw my GC application if I move. I'm little worried and I've read some posts that after the 6 month period and if your I140 is approved (which in my case is true) the employer can't do anything about it. Can anyone share their experiences if they went through a similar thing ?

Hi Naagarajan,

Were you able to find more from your Attorney/HR as I see mixed responses.

It's a good idea to send such a letter, but instead of sending it as a vague entity of legal immigrant community, the letter should be from IV using an IV letter head.

I am writing these posts for the benefit of many who might not know how the legislative system works in the USA. I was in the same boat till some time ago and am happy to pass on what I learnt.
If you believe that I have made any factual errors, please reply to this thread and I will modify the information here
What does Congress, Senate and House mean?
The Congress, which is divided into two chambers, a Senate and a House of Representatives.
The Senate is composed of two members from each state as provided by the Constitution. Its current membership is 100.
Membership in the House is based on each state's population, and its size is therefore not specified in the Constitution. Its current membership is fixed by statute at 435.
More information about the houses can be found here
http://en.wikipedia.org/wiki/Government_of_the_United_States#Legislative_branch
How can a bill be introduced in the house?
An excellent reference for this is this article again at wikipedia http://en.wikipedia.org/wiki/Bill_(proposed_law)
In a nutshell, any member of Congress (House and Senate) can introduce a bill in the Congress. If its a house bill, it has a number like HR.4437 or if its a senate bill, it is given a number like S.1932. Once a bill passes one chamber, it has to be approved by the other chamber too. The other chamber need not pass the exact same bill. If modifications are made to the bill in the second chamber before passing it, the bill now has to go through a conference committee made up of a few members of both the houses that negotiate to come up with a common bill and then this is sent to both the houses for a vote . If it passes in both houses, it is sent to the President for his signature.
Does a bill become a law once it is signed by the President?
(Updated courtesy of H1B-GC)
Once the President signs the bill, it is printed in the Federal Register and 90 days after it is printed, it becomes a law (United State Code). An excellent reference for the whole process can be found here

Please help me.I have been called for biometrics this weekend. Will it be of any use if I ask them what to do?

Hello All,
Please follow the below Points exactly as it is. so that we all are in same voice, whoever registers for this conference call Please do the same as below. this is a request from me so that we are all sounds and acts same. under one organisation IV!
Senator Casey, as you may know, immigration system is broken, even for legal immigrants. Our community represented by Immigration Voice, face a waiting period between 10-25 years before we get our green cards.
During this wait, we lose many opportunities and it inhibits our contribution to our companies, and the economy as some of the laws are old and archaic. When you are elected to serve PA again, will you support our provision of eliminating country caps on employment based green card system? You see, when an employer decides to hire us, the one question that is never asked to attain the job is which country was I born in, however, this is the very question that defines our community and the mess we are in today. Inaction only perpetuates the unfairness, and we would like to know your take on this matter.

I am travelling to India from Newark, New York via FrankFurt on Lufthansa.
Do I need to have a transit visa ?

Mine took 5 business days to arrive. Both lawyer & myself received copies of RFE. It has a golden paper with Immigration officer # incharge of your case. You need to include this paper on top of your response while mailing back so that the papers reach the officer.
For paystubs BC and other queries they give you 30 days but the catch is the 30 day counter starts from day you receive e-mail so by the time you receive the letter with what is needed you have already lost 5-7 days.
In our case also, We received a copy of the RFE along with the golden paper you are referring to. They give an additional three days if the RFE was received by mail. The counter starts from the date in the RFE letter. I don't think it starts on the date of email.
On the golden form, there is a "CUD" date along with officer info.
I believe, that is the latest date on which USCIS should receive your RFE.
Our RFE letter was dated April 6th. CUD shows May 11th 2009.
Thanks,

The best option for you is to go to India now, and get registered marriage done. As long as the marriage happened before the GC approval you will have the option of follow to join, otherwise a really long wait.
Get the parents to agree ( scare them into submission). You need 30 days of court notice before the actual marriage can be performed, (take care of that now, while the decision is being made) fly home and get married and then file for follow to join for her.
The OP mentioned he's getting married in december 2010 and we're all giving his reistered marriage suggestion, which is great but we need to check if he has found a bride or not yet or is december just a date planned by your parents? Just kidding:D

You know why AILA doesnt know jack about this?
Coz they are threatening a lawsuit. And I am not saying that is the wrong thing to do. USCIS and DOS manipulation deserves a Tsunami of lawsuits.
But the thing is, if anyone knows ABC of litigation, when you are in negotiations with a party (or parties) threatening lawsuit, you dont blabber away details of what is going on and what happened so far. The conversation is thru lawyers only. The plaintiffs and defendents take a back seat and let the lawyers do negotiations without divulging vital information. That is exactly why USCIS is not telling anything to AILA. Nothing personal there, but that is just how lawsuits work. I dont think Emelio Gonzalez would even say "Hello" to anyone in AILA coz there is a pending lawsuit. USCIS must be talking to AILA thru its internal counsel (their own government lawyers for defense from lawsuits).
So it makes sense why AILA doesnt know about this and thinks its "fluid". They are not misleading. They are just sitting at the wrong table wheras Immigration Voice was sitting at the de facto negotiation table (Read the businessweek and its *hint* about white house talking to immigrant groups. Which immigrant group other than IV represent hi-tech workers ? )
So no wonder why AILA and IV have a difference of opinion here. Coz they are both talking at different parts of the government.
I am not exactly a groupie of Immigration Voice, but I think on this one, IV deserves a round of applause.

Situation: I have to sublet my apartment for a few months and will have to transfer the lease on the subletters' names, which means they will have their names on the mailbox for few months. After that, the lease will be on my name again. I am worried that in case if my GC comes in the next few months (being an optimist here), it may not get delivered if my name will not be on the mailbox.
Concern: I am hesitant to fill out the AR 11/address change form since I will have to do it again in a few months when I return; they haven't been found to be reliable (several members have posted related experiences, the most recent being:http://immigrationvoice.org/forum/showthread.php?t=16242
Question: Does anyone have any suggestions as to how to best deal with this situation?
Thank you in advance.
No good option exists in such a case in my opinion.
From my personal experience (as has been suggested by somebody before) talking to the mail carrier is not the best option (how about when the mail carrier goes on vacation and somebody else replaces him/her).
Putting mail on hold is one option (which cannot be done for more than 4 weeks and is notoriously unreliable; both by the online option and by filling the form out at the post office and dropping it off personally). I have been bitten both ways.
Mail forwarding is obviously not going to work because most USCIS (I say most because some people have actually had USCIS mail forwarded) letters carry the notation "Return Service Requested".
If you stick to the letter of the law then if you are not staying physically at an address you should notify USCIS (even if not for a few months) either by calling them or by filling out the form AR11 online AND sending them the paper application.
Or if nothing works (like in my case when mail hold didn't work) then get a PO Box address (like I did) and then have you lawyer call USCIS and have the address formally changed. At least that way (most likely) you will have mail securely coming to the address. USCIS should send you a letter acknowledging the change of address to the NEW address soon, and most likely you will see A LUD on your pending applications with USCIS.
Regards.

Obama wants to begin work on immigration reform (http://www.washingtonpost.com/wp-dyn/content/article/2010/05/05/AR2010050504563.html)
WASHINGTON -- President Barack Obama said Wednesday he wants to begin work this year on legislation overhauling the nation's immigration system, firming up his commitment on a key priority for Latino voters and lawmakers.
Obama's comments at a Cinco de Mayo celebration at the White House reaffirmed his long-held support for immigration reform. He went a step further than he has in the past by calling for the work to begin this year.
Latino groups have been calling for Obama to deliver on his campaign promise of making immigration reform a top priority, with some activists and lawmakers in the Congressional Hispanic Caucus complaining he wasn't doing enough.
Obama clouded the issue last week by saying "there may not be an appetite" in Congress to deal with another hot-button issue immediately after grueling fights over health care and financial regulation.
There also may not be enough time left on the legislative calendar to take up a contentious issue with midterm elections looming in November, but by making the commitment Obama may at least be able to tell Hispanic groups he tried.
Obama acknowledged immigration reform would be difficult to achieve and would require bipartisan support - something that's lacking in the Senate right now. And he made no commitment to finishing the process this year.
But he said it was the only way to deal with the nation's immigration problems.
"The way to fix our broken immigration system is through common-sense comprehensive immigration reform," the president said.
"I want to begin work this year and I want Democrats and Republicans to work with me."
ad_icon
Obama again denounced the law passed in Arizona that allows police to require people to prove they're in this country legally. He said federal officials were monitoring it for possible civil rights violations.
If President Barack Obama had said Wednesday, "he wants to pass this year a legislation overhauling the nation's immigration system", would have had more impact that saying "he wants to begin work this year on legislation overhauling the nation's immigration system".. So he just want to begin this year !!! ?:confused::confused::confused:

austingc,
Be careful, if your H1B extension is pending for whatever reason and you leave country then the pending H1B extension will be denied. If you think otherwise, simply consult your attorney.
Madhu, AP has nothing to do with work authorization. In order to work you need either H1B appoval or EAD. AP or Visa is used to enter inside the country and that has nothing to do with work authorization. I have used AP several times and contnued with H1B and even got H1B extension with I-94. The only confusing thing is going out of the country while H1B transfer is pending and entering on AP to continue on H1B. Can you educate me? How does this violate LCA and trigger NOID?

Pappu (Himanshu) is being modest here by not mentioning that he was the one who spent around 10-12 hours designing the ad. It took a lot of time for him to design this nicely after the text was finalized.
So please join me in Thanking Himanshu here for spending so many hours on this advertisement, talking and negotiating with Roll-call newspaper and also for showing up at the rally despite his requirement to be close to his family.
