Yes I filed I-90 and sent all supporting docs I had . BUT I did not have the copy of the Green Card..I LOST IT THE SAME DAY I GOT IT !.....I went to my old address to collect it. Returned back from work , went for a 1 hr work out. It was no ordinary Gym .24 Fitness with more than 100's of locations in every state out here. It was a very slack time ...and hardly 5 people came out between the time range of the theft , per the video cameras. The Manager refuses to let me see the cameras. Keeps telling me the same bull shit " We take this very seriously ...blah...blah.... so far we have no leads" ...and the PO / Detective in charge of the case only works Tue-Thurs. Never returns phone calls. I gave him so many leads but ...its the same.. or worse cop attitude compared to India . .....then if u keep asking them and following up ...they keep giving being defensive ...and there is nothing u can do to make them accountable.

How long will it take before I get actual GC. USCIS told me it can take upto 3.5 months +. Any idea about the avg time in real terms ?

I-90 usually gets processed in about 8-10 weeks. It is not required to have GC copy (as most people may not have it). Police report is very important (and you did send that), as your card was stollen.
Next step is to get new passport (if that was also stolen); go to local indian consulate and get that going.
After that, take I-90 receipt and your travel plan (preferably with iternary - even prelim iternary is fine), to local USCIS office with infopass appt and they will give you temporary stamp valid for couple of months or so (to cover the time till you get your new GC). Hope you already have your new biometric appt already.
Chances that they will ever find the thieves of your documents are very slim. They rarely do that here.
Keep police report. very important to save you from identity theft disaster as well.
Change all your credit cards etc. Inform all concerned parties (bank etc). Put a credit monitor on your SSN so you dont get identity theft issue. It is definitely worth doing that under your circumstances.

A definite NO to TCS. If you need to travel within USA for a project then TCS expects you to relocate or you take care of all travel related expenses if you do flybacks.

Hi All,
The USCIS clinic I had been to does not have chicken pox vaccine and are not sure when they will get one. The Dr. said that they cant do anything about it and can write on the form that no vaccination was available. But she was not sure how USCIS would decide on this comment. Has anyone run into similar situation? What are my options in this scenario?

As far as I know, any expense for H1B is employer's responsibility. It has NOTHING to do with prevailing wages. I think she(lawayer) meant if you are "well paid" i.e. above prevailing wages, why not pay for your H1B which again is BS...

We joined IV few weeks upon the acceptance in early jan '06 and we contributed many times and will continue to do so. Also brought in new people who happen to be Indian as my husband only works with Indians, or to put it in better words; the people needing Green card in the company are 70% Indian and 30% or so Aisian, so we could not possibly bring anyone of our origin as there are just a handful of EB3 souls from our country stuck in retro.

I finished my 6 month period and was planning to move on AC21 to a different company and the employer is threatening me that he would withdraw my GC application if I move. I'm little worried and I've read some posts that after the 6 month period and if your I140 is approved (which in my case is true) the employer can't do anything about it. Can anyone share their experiences if they went through a similar thing ?:mad:

USCIS can not approve cases in July for EB catagory. If uscis have visa numbers then uscis have to accept I-485 petitions.
At the year end we will know if any visa numbers were wasted just because USCIS didn't want to accept the 485 applications. Plus if there are wasted visa numbers than DOS also need to be blamed for making wrong assumption regarding exhaustion of visa numbers in July. Again this is all speculation.

This is what my lawyer said. If is for those that filed after Feb 2008 then they will have to wait for years to get their i-140 approved (EB3) or get it aproved almost immediately for EB1/2).

Thanks for the reply. It looks like the second RFE was based on the response to the first RFE. My RFEs were straight forward. So I am hoping that there are no more RFEs but USCIS no one ever knows.

The company can certainly cancel your H1B before you resign. They can call it a firing if they want to. But I don't think they can stop you from joining another company, I mean they cannot put restraining order.
If you are on payroll, I don't think H1B validity would be in question. I am not sure about the H1B race between cancellation and transfer.
Company A where i am working as a consultant has offered me a permanent position, Company B is my employer.
Company B is threatening to sue me if i take up the permanent offer at Company A.
Company B is aware of the offer, I have a contract signed with Company B but the contract duration is 2 years, i am on 3 rd year with Company B. I have 3 year extension till 09(with approved I140)

My MIL's extension of stay was denied in Apr 2008, while her actual I-94 expired in Jan.
I have done quite a bit of research on this one. I personally wrote letters to the American Consulate in Mumbai, the CBP officers in the US, and even talked to the POE officers at the port of entry where my MIL was planning on entering. All of them confirmed that one could come back after the denial provided he/she left within a reasonable amount of time after the denial. I specifically asked all of them about the applicability of 222 g, they assured me not to worry. American Consulate confirmed that my MIL's visa is still valid and is not revoked. My MIL left within hours of the denial email.
When I called up nearest POE, an officer looked up my MIL's immigration records and confirmed that as long as she pans on keeping her visits short, she is welcome to visit again without requiring another visa.
With email trail of my conversation with the CBP officers, and assurance from the POE officers, my MIL visited us here in the US last year, stayed with us for around 5 1/2 months and went back recently. She did not face any questions at the POE when she entered.
So, in general, it might be ok to come back after a denial of extension. I would call your intended POE and ask them if your parents/relatives could come back.
with recent happenings, I would avoid Newark though. ;-)

There is good chance that 01/01/2005 will stay for a few more months. Trackers show a quite big number of pending ROW cases from 2004. But if they decide to move it (I hope to), it will go to Jun 2005- when first Perm cases started.

Can anyone tell me should we need to use simplified application or regular application while applying for canadain immigration.
I have a US MS degee and in US for the past 7 years and working for the past 4 years.
If its regular application do we need to submit police clearence and medicals at the time of submission. The website was bit confusiing so thought of sharing it here.

I am in 8th year H1B.I have transfered MY H1-B from Employer A to B and recently joined company B. (H1B approved and valid until end of 2010).We also filed 485 @July2007 and got EAD & AP.But we never used it. Unfortunately since I have changed my job and my old employer canceled my 140 so USCIS directly revoked my 485 application also. Right now I am working on filing MTR with attorney.
I haven�t transfer my wife H4 to the new employer yet.I know I have to do it ASAP.She has valid H4 and 194 & visa stamp valid until end of 2010 from my old employer ��A��.Could someone please tell me is my wife is out of status? I am just thinking of wait for a while until the MTR go through and results..

H4 must be associated with your latest H1b. Get it transferred immediately.
