If we send one combined check, how would consulate people would know to what address they should mail the passports?? do they mail the passports to the address written under "other address" section in the application?? I would have not worried much if they have clearly labelled as "mailing address" or some thing similar instead of "other address"...
also, advantage of sending self addressed envelope is that you will have the tracking number, but if you send additional check, there is no way you would know the tracking number...
I am still un decided whether to send self addressed expresss mail envelope or combined check (mailing fee included).... damn consulate.. .why make soo complicated...

I renewed my passport at CGNY last month. Here's what needs to be done:
You fill out a portion of the form online. When done, it will generated a PDF with your application number on it. You have to then print it and complete the remaining pages by pen. You also need to complete a "Nationality Status Verification Form". Its on their website.
I mailed the forms along with the supporting documents and photos to the consulate address in NY via USPS (I chose the most secure option available). Here is a list of supporting docs:
1. I-797 copy (notarized), this could be I-485 in your case
2. Electric bill showing proof of residence
3. Driving license copy (notarized)
4. One combined money order for the application fee + express mail cost

Your source of confusion about the self addressed envelope is probably the PDF instructions on their website. I think they are outdated. Just go by the web page instructions @ RENEWAL OF PASSPORT OR NEW PASSPORT - www.indiacgny.org (http://www.indiacgny.org/php/showContent.php?linkid=225)
Also, I remember seeing a section in the application form about minor children. Good luck!

Hi all - We have entered into a contract for a home to be closed in May'09. Can we claim our 8000 tax credit ahead on our 2008 return (ahead of our closing date)? We have the address of the property. Its just the possession / closing will be after April 15. Thanks.

You start working for your new employer after you receive the copy of H1B transfer receipt.
Try to collect the below documents from your current employer;
1. LCA Form 750 (pre-perm) or 9089 (perm) & approval page
2. 140 Approval Notice
3. Employment Verification Letter that was initially submitted with your 485 - at least a content.
4. You should have the copy of 485 form w/ you - as employer can not submit with out your signature.

I (on H1B) and my wife (on H4) want to visit Canada for 2 weeks and come back to the USA. My question is, will we need to get USA visa to come back or not? our current visas is expired.

I did exactly this in September 2010. I have an expired H1, wife and daughter have expired H4 but we all have valid I-797. Got a Canadian visa - took about 3 hours in NY.
Drove to Canada via Niagara Falls, stayed for a week in multiple cities. Drove back to the US. On the border, the officer did automatic revalidation (took about an hour as she had to refer with the legal guy about some technicality) and issued new I-94s (charged $16 each) and we were on our merry way back home.
Just make sure you don't hand over the I-94 that came with the I797 to the officer when you go into Canada.
Probably the OP has already taken the trip, this information may help the others planning to do the same.

There is more than one person who is on EB3 and has their I-140 approved on this future pay promise. Since this is for future employment, it makes sense if the imployer says I'll pay him then.

My lawyer filed I-140 for me and receipt date is Janunuary 30, 2006. It is approved Last week from NSC. Don't worry about your I-140, if you apply for EB-3 immigration visa. My lawyer told me things are going to be worse now. We have to very patient to wait for when the I-485 will be available.

It is good news that finally Pres. Bush is putting his weight behind this thing, it is a pity his popularity rating is this low right now.
Lets all hope for a couple of good developments in Iraq over the next few weeks and for gas prices to cool down. Clearly this thing is not going to come off without his strong backing and bully pulpit.
He appears confident, This was a centerpiece of his 2nd term agenda and recently saying in mexico that one should not underestimate his ability to push legislation through congress and now resurrecting this almost dead issue, and making this his first live televised address on a domestic issue. He seems heavily behind this. This makes me cautiously optimistic.
How this will all affect us, if it passes is another story. I do worry about the huge volume of cases overwhelming the system and us all waiting many many years.

That way both purposes will be solved. You may get a good spouse & bonus GC within no time.
2. Study till you get a PHD. Look for an employer who wants you. File under EB1.
3. Invest some $5-10 million in rural US & get GC in EB-5 (or EB-4 donno which one exactly)
4. Slightly longer but still better than current EB3/EB2-I, die early, pray to god that u be born as child of a USC or at least pray to be not born as Indian/Chinese/Mexican or a Fillipino.
Just kidding..Though 1st 2 options are genuine & valid. Do not waste your time & energy as to understanding why retrogression happened, why dates move back & forth etc etc.
So GC is more valuable than your life...? US is not the only country in the planet. There are 6 billion people living in this world and only 320 million in the US. Nebraska will deny 140 for commerse degrees. They purely base their approval on education not on work experience. I guess they also know that people fake their experience but cannot fake the education. This is a sad state of affairs but I guess our country men are also partially responsible.

that is not true. GC holders have to report it. there is a check box in the AR11 form for Permanent Residents. and the form can be found here:

I have already written a letter to the investigative services. I sent them a nice polite letter. When I called them, they acknowledged the letter and made an effort to track the documents they never received. In our case, our documents were either lost by the DMV office or never sent. Finally, they gave up and asked us visit DMV office to resubmit documents. Hopefully, it works this time. I'm going to wait until June to see what happens. If nothing happens, then I'll probably write a letter to the commissioner of driver services.

I & my wife got our SSN cards as students. Now both of us got our EAD cards and plan to switch jobs using AC21.
Does it make sense to apply for new cards without the INS restriction printed on the SSN card

Did not have any problem. Got I-94 per my new 797 (3 year). However, somehow the officer issued I-94 for one less day (i.e. one day less then the end date in my 797). When I asked he said his computer shows like that. I did not argue just for one day.

Hello all,
This is my wife's situation: We applied for 485 in July, got the EAD approved today. Her 180 days end on Jan 17th, after which she plans to use AC21 (with either H1 Transfer or EAD). Her current H1B will be expiring in March 08 ( she is already in her 6th year). So here are my questions:
1) Can she keep extending her H1B after invoking AC21 with H1B transfer based on the fact that her I485 is still under processing?
2) If she wants to go for studies (part-time or full-time), does EAD has any benefits? Can she apply for federal tuition assistance because of having EAD? If she uses EAD for studies, does that negate her H1B even though she is not working?
Sorry if these questions have been asked before. If they are, then please guide me to the right place since i am not able to find them in the archives. If not, then any advice by the forum will be greatly appreciated.
