You probably missed his question. He is worried that CVS might not file her H-1B in a timely manner which would result in her missing a chance at the lottery. As a back up, he wants to file through a consulting company.

Hi all,
Greetings! I need to visit Canada for a week begining 7/27/07. My lawyer will be mailing my I-485 mostly this monday. He recommonds not to travel out side US until we get receipt notice. My Canada trip is very important. AS per my knowledge we will not get new I-94 as long as we are traveling for less than 30 days to Canada. Any thoughts about the impact of traveling to Canada before we get receipt notice for I-485?

If to get US GC is my first preference then I would cancel that trip untill I get 485 receipt.

I am no longer in the race. My race is over. But to look back here is what we did
a) Visited Washington DC , mostly on our own expense
b) Organized numerous meeting in NJ to increase the awareness
c) Coordinated DC rally
d) Handed overthe fliers at the India day parade urging people to come and help.
e) On the negative side for few , I also participated with few others to make all IT jobs, zone four.
What we were trying to do was not only for oneselves but ourselves. Unfortunately, the awareness is just not there. Ideally, I would have expected people with later priority dates to be more active but they are not . Almost all of "active" us had PD from early 2006 or earlier and most of them EB2. Now guess what, we are done and we could have been a great and powerful organization, but for your support. Hence, I have issues with the folks in our community for the following reasons
1. Not looking out for themselves.
2. Expecting too much from one group/persons and not taking inititative themselves.
3.Not educating themselves on what is the difference between legal /law and administrative rules, DOC VS DOL VS USCIS.
4.Not being able to analyze what can be done or cannot not be done.
5.Just being afraid to even talk to a lawmaker.
6.Asking those who take inititatives do things with an authority as if we were paid to do this on your behalf.
7.Not realizing how much your are loosing or can loose because of your precarious situation.

Nobody wants to contribute any money and wants it all free. They will pay lot of money to lawyers though.

True, I know that is for visas. For H1 application i am not sure, also here the latest action is denial of h1 transfer not original h1 application.
Anyway that's what i am trying to find out. Is my old application still valid and can i transfer to some other company.
Please, correct me if I am wrong here. My understanding on this is uscis follows 'Last Action Taken' rule which invalidates the previous visas issued.

This is what I was saying...there is also an element of security into the multiple EAD. Most likely, only those whose security check has been cleared and suffering from retrogression will be issued multiple year EAD. Thus, if one is issued multiple yr. EAD, it simply means that the case is already pre-adjucated and is just waiting for a visa number.

I had an RFE in I-140 because USCIS said my Labor was not approved (which obviously was a mistake). My RFE was responded back with the proper Labor approval documentation in October 2007, but still it got denied on January mid 2008.
In result of this, I-485 got denied too. My lawyer will work on this and will file an MTR (Motion to re-open) if needed and says there is nothing to worry about or panic as this is a mistake made by USCIS.
But, this thing atleast helped me know that what was happening with my I-140 and that's a good news.. Now I will be in loop the whole time.

Do bills introduced in one congress / senate expire when the term expires? I mean would the CIR need to go through the senate again next year if it is taken up again?

Guys, we should make a clear distinction between getting a chance to apply Vs getting a Green Card. If we emphasize that we lost a chance to get a green card, it will lead to a simple rebuttal that there is a limit and it ran out, hence we cant get it. Few people(specially management) I tried to explain did not intuitively distinguish this, and for them it made sense that USCIS/DOS would do what they did. Then I had to emphasize that I(and everyone else) were not demanding a Green card because of this Fiasco we are requesting an application towards it, be accepted because of the July bulletin.
Again, we emphasize that we are willing to wait in line for actual GC to get few benefits of the application being accepted should be our emphasis.
As for the increasing/recapturing the GC numbers, that is a different path(legislation) and struggle for us.
My sisters and brothers from immigrationvoice.org has organised a flower campaign for tomorrow. The flowers send to Mr Emilio Gonzalez hopefully will remind him that behind every flower sent there is some one who is suffering for years. People who came to this great country dreaming of freedom and liberty yet who are now chained to their employees by the archaic laws of immigration. Young men and women - who had embraced globalization , came to this far off land LEGALLY, worked hard and paid taxes and then see the best years of their life pass them by. Without a green card they cannot change jobs, cannot get promoted, cannot get another position within the company, cannot do a business or cannot afford to put substantial stakes in the ground - like buying a house. In short these flowers are sent by people - law abiding global citizens - who have been kept in suspended animation for years by the immigration laws. They were given a ray of hope on June 13th yet - and they scrambled to put all the paperwork together - yet that door was again slammed shut the day it was supposed to be opened.

Blue cross blue shield covers maternity but there may be a wait time of 6 months.contact an insurance agent and explain your situation. Its really a simple process and you need to understand a few words like out of pockets expenses, deductible, copay etc.
I know in michigan BCBS charges $133 for maternity rider. Getting an individual policy is very easy and dont let some guys scare about fine print and all that.The fact is they are too lazy to know about something new and they go preaching others to stay away from it too.

My PD is January 31, 2005 and my file is at a local USCIS office after doing an interview back in May. The officer didn't approve it then because... well I have no idea...
The last I heard from that office is they're waiting on a visa number...

Looks like from the table below, in 2006 it moved a couple of months in November, but in 2007 it didn't move until January.
