Yes I filed I-90 and sent all supporting docs I had . BUT I did not have the copy of the Green Card..I LOST IT THE SAME DAY I GOT IT !.....I went to my old address to collect it. Returned back from work , went for a 1 hr work out. It was no ordinary Gym .24 Fitness with more than 100's of locations in every state out here. It was a very slack time ...and hardly 5 people came out between the time range of the theft , per the video cameras. The Manager refuses to let me see the cameras. Keeps telling me the same bull shit " We take this very seriously ...blah...blah.... so far we have no leads" ...and the PO / Detective in charge of the case only works Tue-Thurs. Never returns phone calls. I gave him so many leads but ...its the same.. or worse cop attitude compared to India . .....then if u keep asking them and following up ...they keep giving being defensive ...and there is nothing u can do to make them accountable.
Long story short - I mailed all other supporting docs but the GC copy . Birth Cert, Police Complaint etc, Copy of DL and Passport etc.
With the cops being such assholes, hell ya, I could just pretend that I never got the GC and filed I-90 and never be paying this $380 Fee !!! but it is GC......didn't want to take my chances of them rejecting my case....for some excuse.
How long will it take before I get actual GC. USCIS told me it can take upto 3.5 months +. Any idea about the avg time in real terms ?

I-90 usually gets processed in about 8-10 weeks. It is not required to have GC copy (as most people may not have it). Police report is very important (and you did send that), as your card was stollen.
Next step is to get new passport (if that was also stolen); go to local indian consulate and get that going.
After that, take I-90 receipt and your travel plan (preferably with iternary - even prelim iternary is fine), to local USCIS office with infopass appt and they will give you temporary stamp valid for couple of months or so (to cover the time till you get your new GC). Hope you already have your new biometric appt already.
Chances that they will ever find the thieves of your documents are very slim. They rarely do that here.
Keep police report. very important to save you from identity theft disaster as well.
Change all your credit cards etc. Inform all concerned parties (bank etc). Put a credit monitor on your SSN so you dont get identity theft issue. It is definitely worth doing that under your circumstances.

Please help with these questions on EAD/AP/H1. I have heard so many different versions that I am confused.
We are planning to travel to India in June/July and both of us have valid H1 extension (I-797) until Dec 2009. H1 visa stamp in PP expired two years ago.
We also have EAD, AP, all valid until next april.
a) is it necessary to go in for a visa stamping at the US consulate ?
b) if we use AP to re-enter what will happen to our H1 status ?
c) if we use AP to re-enter should we necessarily use EAD to revalidate I-9 ?
d) Assuming we use the AP to re-enter and get a "parolee" I-94 until Apr 2010, what will happen to our H1 approval which expires in Dec 2009 ?
e) if we get a new H1 stamp and use the H1 to re-enter what will happen to our AP, EAD and AOS filing ?
f) what will happen if priority dates becomes current (I know, I know, that sounds silly, but I still gotta ask) when we are out of the country ?

I just got a call from back home that my father had a stroke. I do not currently have an Advance Parole.
I will really appreciate if someone can guide me on getting AP immediately.

Check with your attorney, get the receipt/copy of AP (if you have already applied), and 485 receipt, and go to the local USCIS office near your zipcode( check for infopass or go there early morning and explain to staff), along with the medical certificate or (hospital admission note from India issued from the hospital/Doctor, they can scan it and send it to your email). It is better to take a print out of a new advance parole petition online and take the required fees and two passport photographs along with you, when you go to the office so that you are well prepared and it saves time. You could request to meet the supervisor/center director, also and explain your critical situation. They can hopefully expedite it or issue emergency parole for you to travel immediately.

USCIS will accept checks for USCIS and Department of Homeland Security. But, please insist that you send separate checks for each application. This is how it is suppose to be done! You send 3 applications and you send 3 checks. The only exception is of I485. This check should be $325 + $70 biometrics fee=$395. This is the only check that is combined. Please note that if I485 and I131 and I765 is not being processed by the same person, it can cause problems. Also note that USCIS creates electronic accounts for each application and issues receipts only after checks clear. That's the reason they stamp each check with its case number on the back. I don't know who advised you to send a combined check. Each form specifically states the payment details. A combined check can cause lots of issues because of the electronic account USCIS makes.

I understand that your are frustrated and panicing....but I would recommend 2 things...
1> Stop calling your lawyer every now and then. You said you have already talke to the lawyer and the lawyer says that he/she is going to re-file...so trust them....give them a few days....
2> Talk to your employer and tell him to be in touch with the lawyer about ur case...why should you be the one doing the running.....What the heck is ur employer doing.....You tell him that you are not going to take shit and run behind the attorney...if he needs the 20-30% from you then he better get his act together....
Do you think companies are trustworthy. I think its better to talk to lawyer directly as you can sue lawyers if they tell lies

My spouse's PD turned current as dates move in July. She has a 485 pending for a couple of years.
My 140 and 485 are pending for a while now and I'm on parole... gathering dust somewhere in some local office in Texas.
Can I apply as a derivative applicant using my wife's 485? Should that make my 140/485 application quaint?
Can I apply after my wife has her 485 approved?
Also, is it possible to transfer my 485 onto her application? Is this common and are there any circumstances in which USCIS may not permit this?

I don't think Dhundhun is talking about visa stamping. It just sounds like a two day trip. Different people have different experiences at the POE if you're driving.
It has been smooth for me with a passport that has a valid I-94 sticking in it. Just a few straight questions: Where do you live? Purpose of visit to Canada? How long? Are you bringing anything back from Canada? Have a good day.
I don't think Canadian immigration takes your I-94 upon your entry to Canada.

You have to go to a Scotia bank branch (pick one near the consulate) and deposit the specified fees and take the deposit slip with you to the US consulate. Check your appointment time and plan to get to the bank at-least an hour ahead of the appointment. Most Scotia banks open at 9am so if you have an early appointment, plan to get the deposit taken care of on the previous business day.

1) If employer A (laid off from) does not withdraw your LA and is still in existance at the time the BEC may eventually process it then you might be lucky and get the LC anyway, since the LC is for the job. This does mean that employer A must have already replied to the 45 day letter, and the BEC must not issue any rfe's (requests for evidence). If that happens you might be able to use the LC to keep the priority date.

4) You can transfer your existing H1B without problem, and work for a new employer B as soon as the transfer docs are filed with USICS. You don't need to wait for approval as long as you don't been to travel.
5) Get your own immigration attorny, don't rely on a corporate one. If you can have the employer write the checks and if need be deduct from your salary. That way it is pre-tax. Also that way you have direct access to the attorny because he/she works for you, not for the company.

Then I think the RFE is about another employment verification letter from your current employer. It seems that your original GC sponsoring employer might have requested for 140 withdrawal which triggered the new RFE. Though we are supposed to file AC21 when we change employers, there is no defined process on the USCIS side to attach the AC21 paperwork to your file. So its not unusual to get an RFE in your scenario. Actually, you should consider yourselves to be fortunate to receive an RFE and not a denial notice instead. I have seen many people in the same scenario who received denial notices and had to go through MTR process to get their I-485s re-opened.

While the reasons why this lawyer is saying the things he is not known to me - I would not generalize.
I dont agree that ALL lawyers/Journalists etc. are in it JUST for the money. There are quite a few - and the numbers are growing, who are seeing the impact of no immigration reform.
That being said 99% of the general public equates 'immiigration reform' to 'Illegal' immigration and not EB immigration reform.
