Our case too transferred from NSC>>CSC>>NSC.
We sent our applications to NSC on July 27th but on the transfer notice, it shows Reciept date as Sept 17th and Notice Date as Sept 18th.
I called the Nebraska office on Aug 5th and she said that my Biometrics results weren't on the file.!!!! wheras i took them on dec 6th 2007.
But when she read my case details ,she mentioned the reciept date as
July 27th.However, i took an infopass appointment on Aug 11th , and the IO (i doubt if these guys are actual IO's though!!), said that my FB1 results and Biometrics have come back.I saw a soft LUD on my I485 on Aug 11th on the evening.
After that i got my EAD renewed from Nebraska.
Still waiting for the approval.

good joke ..but of late, I wonder if we will have any campaigns in the future or are we resigned to our fate ?
This is certainly not a joke based on my experience.
I travelled to India on May 1st and had to attend for H1B VISA renewal at Chennai consulate on May 4th. I did not have enough time to take any print outs in India and so decided to get all the documents printed and be ready to go to the embassy when I land in India. With all the rumors and embassies requesting more documentation, I started colecting all the documents for the last 9 yrs I have been in in the US and they weighed total of 5 lbs all together and since I was carrying them as part of the carry-on, the total weight exceeded the limits and had to request/explain about the US VISA documentation to the guy at the couter and he was knowledgable enough to understand the situation and allowed the documents.
When I went to the Chennai consulate, it took a while for me to get the security cleared, since they take out all of your documents w/o any commonsense and consideration for all the effort you put into organizing your documents. My advice to people going to Chennai consulate is not to waste time organizing your documents. You can do them when you are past the security. Once the secuirty was cleared, the interview process was smooth and the VISA was issued. Not a single document I carried was asked except for I-797, I-129 and LCA and the interview was for less an a minute.
I will be travelling back on May30th through JFK and again with 5 lbs on documents, sorry its 5.01 lbs since I have my new US VISA in my passport now :). Hope everything goes well at the POE.

We started talking about immigration etc on the plane and she had casually mentioned that she is praying she gets a project because of the October tanking of economy while she was out. She was at a different window and then she started walking behind the IO crying and ran into me. All she said was "client letter"-no time for a conversation. I do not know whatever happened to her, didn't see her come out while I waited for bags and went through customs.
TARP POE problems sound like rumors to me. But they are cracking down on benched consultants.

Info pass doesn't work all the times.
On Phone call
When I called them on phone a nice polite lady took the phone and said my case is pending in name check since my receipt date needs to pass the 30 days they cannot do anything with my I-485. Once the processing dates reaches August then my case will be assigned to an officer and because of the 180 days rule on name check the office may skip my name check and may assign me a visa.
Info pass Experience.
The officer spoke very politely and said my name check is stuck I need to wait for Feb 2009 to hear anything about my name check. I took the 180 days memorandum Name check rule and showed her. She told they cannot follow that because the FBI has given them the time frame to process all the pending name check waiting for more than 180 days on FEB 2007. My name check is initiated in the mid of October 2007 which is almost 10 months.
Now whom should I really on Info pass or Phone call?
My case is pending in the Texas.

(3) If i find a employer who files for a new PERM labor - until the labor gets approved which is taking 5 months at present, what would be my status until then?
(4) My GC sponsor employer had screwed up taxes/no year end returns for past 5 years, which created the problem, how to take this to the next level?

For self petition, You need to go through the National Interest waiver channel. For that one has to prove that issuing the GC to you is in the interest of the country. Becuase of your extraordinary talent, patent, research will benefit the country. I am not sure if you would qualify for this. The better way would be to find another job and start the GC again. If your 140 is approved, you can retain your PD. But if denied there is no way to retain the PD and need to start from square one. Its very unfortunate.

With Shiela D, the problem is not hefty money but also an iffy acceptance with the INS. Atleast for mine, no acceptence with INS even after giving Shiela what she wanted! And moreover, a denial of this sort adds yet another fowl feather in your hat!!

Hi all,
Greetings! I need to visit Canada for a week begining 7/27/07. My lawyer will be mailing my I-485 mostly this monday. He recommonds not to travel out side US until we get receipt notice. My Canada trip is very important. AS per my knowledge we will not get new I-94 as long as we are traveling for less than 30 days to Canada. Any thoughts about the impact of traveling to Canada before we get receipt notice for I-485?

I just canceled the trip to play it safe....my 485 made it in time on July 2nd only for me and the rest of the July 2nd filers to watch the fiasco unfold...
I would suggest, do what your attorney says...

Hello All,
I am in critical situation advice me ASAP.
I came to USA in June 2007 on H4 Visa Status Valid until Sep 2009.
Got H1B approval and my employer filed for change of status I-797 ( H4-H1B).in the month of MARCH 2008. Got SSN in the month of April 2008.
My employer didn't place me in any of the project and not even pay me anything since 1 yr.
Recently my husband got his H1B Transfer and extended until sep 2011.
When my husband applied for his transfer I didn't apply for H4 as I am on H1-B Status.
Now I came to know that I should not live in US more than 1yr with out any Pay stubs .
So I am Planning to go India and get back to H4 visa.
1. So what are the different scenarios to get the H4 Visa ?
2. Will the US consulate people ask about my H1 payslips and all when I go for H4 Visa stamping?
3. I don't have any payslips anything so will i get H4?
4. Can I make a complaint to INS labor on my employer and keep the complaint safe side when I go to US consulate?
5. Should I mention about my H1-B or just wait until the US consulate people ask about my H1B?
6. When I applying for H4 if the US Consulate people ask me about my H1 like U have H1b valid until 2010, then why do you come for H4 what should I Reply?
Recently I came to know my employer is having few cases pending on his Company and he started a new company B on same address where my company A has exist.
So could any one please help me in this situation.

You should get your employer to do back wages and issue you W2 so you can amend taxes to show your income. There is a very high probability that you will be denied change over in to H4 in the current state. Check with your attorney for further options

Perhaps she could apply on the grounds of No Objection from Home Country. From what I understand, she needs a No objection certificate sent by her country's embassy in the US directly to the department of state.
Once she get's the waiver, she can be in the US on H, L, or LPR status.

I appreciate we are all in queue to have that resident card. Most, if not all amongst us have been fortunate to have an education, travel, find work and a livelihood here in America. However, there are the less fortunate who may not have the opportunities (or the possibilities) The Diversity Lottery program extends that possibility to those less fortunate, restricted in their lives for whatever reason and so on. Giving people an opportunity so they too can have a better future is (one of the) beauty of this land. This also brings more diversity to the land, where people of different backgrouds / origins come together. Personally, I find it all quite fascinating, because I grew up in a multicultural town, where people hardly integrated. Everybody formed their own little �towns�. Anyway, I for one, do not support the removal of this program in its entirety, because I do not believe someone with a Masters (I have one) or a PhD education, should have more privileges (in addition to what's on hand) to folks who may not have any? Anyway, it�s just an opinion.
