As PERM processing becomes faster in recent months, icert problems continue though. DOL has reported that the incorrect error message that pops up upon entering a date for the prevailing wage source is the result of recent system edit. The glitch will not affect useability, i.e., users can bypass the error message and submit LCAs for processing. In addition, a fix is in development and will likely be in place today or tomorrow. Common recent problem is receiving an inappropriate system warning when entering the Prevailing Wage source. We hope these problem will be fixed soon as the PERM process becoming rather annoying. We will keep our readers posted.

My husband is primary applicant.
1.Should I apply with his ID or I can create my seperate ID and apply through that.
2.For c9 Eligibility status which option should I select?.

I am an employee in a TARP company and according to the company rules, I must be given a notice (of 2 months) before being Fired/laid off. I was hired on H1-B and the company has processed my I-140 and waiting on my priority date getting Current.
My H1-B has to be extended now and the company's lawyers say they have not yet decided about their policy on H1-B extensions. It is expiring in the last week of this month and they have not filed yet nor they say they won't file.
According to the rules, can they just say that they will not be filing my H1-B extension as the company policies have changed? But I am still an employee, and this way I will not be given my notice period. Any suggestions please.

My wife got her H1B approved couple of months back (Sep 2008). She did not get a job till now (Nov 2008) due to the market conditions. We need to travel to India early next year and have to do visa stamping.
1. Can she go back on her H4 and then go to India and get it stamped? She had been on H4 since Oct 2003 up until Oct 2008 (when her H1 became valid). If she goes back on H4, how long will it be for? Does her clock for 6 years of H4 start again after this change back from H1?
2. Once she comes back from India, can she look for a job and get back on the same H1? Will she be required to go through the cap? How much time will be remaining on her H1 (6yrs - 2 months that she worked)?
3. Please advise if there are some other options to keep the H1 (do not want to go thru the cap again) but not getting it stamped when in India. If we get paystubs from the employer for some months on H1, will that help?

I filed for my wife's 485 on July 2nd. Assuming USCIS accepts/issues a receipt, how does USCIS decide which case to pick up first, would it be based on RD OR would the case get priority over other cases since the primary applicant has been approved? Any memos, opinions around this?

Does any one have any advice about AC21
Is it advisable to file AC21 soon after changing/ joining new employer?
OR
Just keep quite and look for any RFE, if any RFE comes up send AC21 form and updated employer information along with it.
IS there any guidelines from people who already did it successfully

i am going for the h1b visa stamping first time in chennai. i took the single dd with 4322 ( 4000 + 322 ) rupees . i took the appointment date also for interview .
in the hdfc bank some other people also took the single dd with the same (4322 rupees ) amount.
but some body told that we have to take supporate dds like 4000 and 322 rupees.
what about my situation now? if i took wrong how come hdfc people will give single dd for me and others .
i am really mad. please appriciate your help. i am waiting for your valuable suggestion. please anybody who knows help me.

You must submit the 485 through a lawyer if your priority is current, check the visa bulletin. You can always file when 140 is approved and you are still employed with same employer. You can also file EAD & AP for work permit and international travel. Get a lawyer asap.

I want to know if i can get a GC without the labour filing. I am currently on L1A visa, but i came into US initially on H1B visa. Given below are the details
H1B petition approved on: 10/01/2005
Entry into USA on H1B : 04/23/2006
L1A petition approved on : 09/23/2008
Different people tell me different things, some say i will still be considered as H1B and hence have to go through labour filing since i entered USA in H1B status. Some say since my current visa is L1A, i qualify for EB1 category and hence labour is not required and i will get the GC in 6 months. Not sure what is true.

Hi: Need some inputs from the excperts in this group on using the priority dates from a different I140 filing.
Have the following 2 cases filed for the same person.
PD - Nov 2004 - EB3 - Labor Approved - I140 Filed
PD - Oct/Nov 2005 - EB2 - Labor Approved - I140 Approved
If we file I485 based on the I140 approved for EB2 case [which has a later PD], can we still send an update to USCIS later regarding Nov 2005 PD and use that PD once the I140 from the EB3 filing is approved? What's the best way to use the highest EB category and oldest PD in this case?
