    IN LARGE PART, modern U.S. nuclear nonproliferation policy began with India. India received U.S. aid under the "Atoms for Peace" program of the early Cold War era -- only to lose its U.S. fuel supply because India, which had refused to sign the 1968 nuclear Non-Proliferation Treaty (NPT), exploded a nuclear "device" in 1974. Decades of U.S. noncooperation with India's civilian atomic energy program were intended to teach India, and the world, a lesson: You will not prosper if you go nuclear outside the system of international safeguards.

    Friday marked another step toward the end of that policy -- also with India. The Bush administration and New Delhi announced the principles by which the United States will resume sales of civilian nuclear fuel and technology to India, as promised by President Bush in July 2005. The fine print of the agreement, which must still be approved by the 45-nation Nuclear Suppliers Group and by Congress, has not yet been released. But the big picture is clear: The administration is betting that the benefits to the United States and the world of a "strategic partnership" with India outweigh the risks of a giant exception to the old rules of the nonproliferation game.

    There are good reasons to make the bet. India is a booming democracy of more than 1 billion people, clearly destined to play a growing role on the world stage. It can help the United States as a trading partner and as a strategic counterweight to China and Islamic extremists. If India uses more nuclear energy, it will emit less greenhouse gas. Perhaps most important, India has developed its own nuclear arsenal without selling materials or know-how to other potentially dangerous states. This is more than can be said for Pakistan, home of the notorious A.Q. Khan nuclear network.

    You can call this a double standard, as some of the agreement's critics do: one set of rules for countries we like, another for those we don't. Or you can call it realism: The agreement provides for more international supervision of India's nuclear fuel cycle than there would be without it. For example, it allows India to reprocess atomic fuel but at a new facility under International Atomic Energy Agency supervision, to protect against its diversion into weapons. The case for admitting India to the nuclear club is based on the plausible notion that the political character of a nuclear-armed state can be as important, or more important, than its signature on the NPT. North Korea, a Stalinist dictatorship, went nuclear while a member of the NPT; the Islamic Republic of Iran appears headed down the same road. Yet India's democratic system and its manifest interest in joining the global free-market economy suggest that it will behave responsibly.

    Or so it must be hoped. The few details of the agreement released Friday suggest that it is very favorable to India indeed, while skating close to the edge of U.S. law. For example, the United States committed to helping India accumulate a nuclear fuel stockpile, thus insulating New Delhi against the threat, provided for by U.S. law, of a supply cutoff in the unlikely event that India resumes weapons testing. Congress is also asking appropriate questions about India's military-to-military contacts with Iran and about New Delhi's stubborn habit of attending meetings of "non-aligned" countries at which Cuba, Venezuela and others bash the United States. As Congress considers this deal, India might well focus on what it can do to show that it, too, thinks of the new strategic partnership with Washington as a two-way street.

    WASHINGTON, June 13 � President Bush had barely left the Capitol after immigration talks there on Tuesday when Senator Harry Reid of Nevada, the majority leader, walked onto the Senate floor to call for a moment of silence. It was time, Mr. Reid said, to pay tribute to American soldiers in Iraq as their death toll reached 3,500.

    A short time earlier, Mr. Reid convened a conference call with liberal bloggers, offering assurances that Democrats would revive debate over the Iraq war. And he pledged to revive it soon, ending the silence that followed the White House�s outmaneuvering of Democrats last month to win more money for the war without a timeline to end it.

    �They�ve been driving this debate very well,� Mr. Reid said later, speaking of the bloggers who have been pushing for Congress to end the war. �I understand their disappointment. We raised the bar too high.�

    It has been nearly three weeks since Democrats have held a formal Iraq debate or voted on an Iraq proposal in the House or Senate. Not since they assumed the majority in January has there been such a lull. During the three weeks, Congressional approval ratings have fallen, and Speaker Nancy Pelosi said she knew why.

    �It�s the war, I believe so, it�s the war,� Ms. Pelosi said in a brief interview on Wednesday. �In terms of the issue that the American people want to have resolved, the war is three or four times higher than any other issue.�

    Some Democrats argue that it is high time for the party to turn its attention to domestic issues � energy legislation, immigration overhaul and lobbying reform � to allay concerns that Democrats have not achieved enough significant accomplishments during the first six months of their majority. But other Democrats are demanding a return to the Iraq debate, which Mr. Reid has now pledged to do this month.

    The proposals will not be new. Rather, Democrats intend to reprise at least four ideas when the Senate considers the Defense Department policy bill: a measure to reverse the authorization for the Iraq war, set a deadline for troop withdrawal, block money for major combat operations after March 31, 2008, and increase readiness requirements for troops to be sent back to Iraq. �On Iraq,� Mr. Reid said, �we�re going to hold the president�s feet to the fire.�

    Democratic Congressional leaders have been stung by the decline in Congressional job approval ratings.

    A Los Angeles Times/Bloomberg nationwide telephone poll released this week found that 27 percent of Americans approve of the way Congress is handling its job, while 65 percent disapprove. And 29 percent of the more than 1,100 poll respondents, all registered voters, said Democrats were working to change how government is run, compared to 63 percent who said Democrats are governing in a business-as-usual manner. The margin of error was plus or minus four percentage points.

    Ms. Pelosi said it had been difficult to convince some Democrats that despite their majority, they are limited in how they can change the president�s Iraq policy.

    �Some Democrats understand that we don�t have the signature and we can only do so much,� she said. �Others are just very unhappy. I include myself among them, being very unhappy that we have not been able to bring the war to an end.�

    With September being highlighted as a critical review period for Iraq policy � Gen. David H. Petraeus, the top American commander, is to report to Congress on the progress of the current troop buildup � Democratic leaders had initially hoped to tackle their domestic priorities in late spring and early summer. But on Wednesday, Democratic leaders said they would not wait.

    �The American people cannot and should not have to wait until later this year for changes in your flawed Iraq policy,� Ms. Pelosi and Mr. Reid wrote Wednesday in a letter to the White House.

    Representative Rahm Emanuel of Illinois, the chairman of the Democratic conference, said Democrats could not be drawn into focusing solely on Iraq. �We have to do Iraq and change the priorities of Washington,� he said. �You can�t become a one-trick pony.�

    The war has been the underlying theme of the new Democratic Congress, with barely a week going by without legislators embroiling themselves in committee hearings, a floor debate or symbolic resolutions for and against the war. Democrats have walked a careful line, trying to keep their criticism alive, but lowering expectations that they alone can influence war policy.

    The month of June, though, has so far unfolded with barely a word being uttered about Iraq. And lawmakers said they were hearing about it.

    Senator Amy Klobuchar, a Minnesota Democrat who was elected last fall, said constituents were seeking reassurance that Democratic efforts to challenge the administration have not fallen off. She said voters had little interest in being schooled in the intricate rules of the Senate, where 60 votes are required for debate to proceed on legislation.

    �I share their frustration, answering them with procedural answers, �Well, we need 60 votes,� � she said. �People are dying over there, so that isn�t always helpful.�

    While Congress must accomplish domestic priorities, she said, Iraq remains the chief issue for most voters. �I think that�s one of the things we�ve struggled with, is finding that balance,� she said, welcoming the news that the Senate intends to revive the debate before month�s end. �It�s very important to me. I don�t want to go home until we do it.�

    Hi, I am a U.S. Citizen, and my husband is not. I would like to apply for unemployment benefits, but I am worried that it may affect his immigration process. We will soon apply for his green card with the help of a cosponsor. I wanted to make sure that he would not be affected at all by me claiming unemployment benefits. I figure that it wouldn't affect him because of the fact that we will be using a cosponsor, but I didn't want to risk it.

    Nina Bernstein, one of the country's best immigration reporters, has a front page story in this morning's Times regarding 30 survivors of the January Haiti earthquake who were airlifted by Marines to the United States and are now sitting in detentions centers in Florida. According to the Times, these individuals were pulled from the rubble and were seeking food, safety or medical care at the airport in Port-au-Prince. When aftershocks struck, the Marines quickly evacuated people via military transports and did not bother with immigration processing.     This was inevitable. As Chris Hayes of The Nation told Keith Olbermann this evening, a boycott could "recalculate the incentives" for the citizens of Arizona and the politicians in the state. Once Super Bowls and major conventions start to go elsewhere (as was the case two decades ago when a similar boycott was successfully used to protest the state's failure to recognize the Martin Luther King holiday), the cavalier anti-immigrant positions will become a lot more expensive. Hopefully, the business community and sensible Arizonans who are appalled by what just happened in their state will mobilize to repeal the bill...

    Hi,

    I need some clarification. One of my friend confued me.:confused:
    My I-485 is filed (I-140 is already approved) by my lawyer.

    I am traveling in Sep end returning in Oct End.
    I have my H1-B extension with me and need to get it stamped in India.

    As per my lawyer, she will file for EAD and AP after I come back. I am not sure what she ment then about the she has filed my application in July.
    As per her there is no issue as she will file my EAD/AP after I come back.

    Will this travel be an issue in my stamping in India and/or getting back in the US after stamping?

    Please advice.

    Hello gurus,

    I have a few questions about my case.

    I have a 3year degree in Bachelors of Science (Maths) and a 1 year degree in BS in Computer Information systems from Golden Gate University in (San Francisco, CA). However at the time of my GC filing, my lawyer advised me that i cannot file for EB2 but for EB3, since my bachelors degree does not evaluate to a 4 year US degree (based on the single source rule). So i had to file my I-140 in EB3.

    Recently i read an article on murthy.com http://www.murthy.com/news/n_combdg.html this article clearly mentions that the person I-140 was denied by USCIS but the AAO overturned the case. I asked my lawyer about this, she says that even thought the person had two degree, they were from the same university, but from my understanding ethiraj college is an autonomous university.

    I have a feeling my case is similar, what do you'll think i should do..

    I got my PERM labor approved yesterday, for applying I-140 were can I find the processing dates for I-140? I mean specific to Country? Because, if I go to https://egov.uscis.gov/cris/jsps/Pro...viceCenter=NSC the processing time for "Skilled worker or professional" is April, 1 2008, does this date apply for all? Thanks in advance.

    I was wondering if this recession could turn out to be a silver lining for those of EB2-I,C who manage to survive it. Come to think of it, with all these job losses theres bound to be a downturn in hiring - resulting in lesser number of EB1 and EB2 ROW applications. This means more could overflow to EB2 I and eventually EB3 (I,C and ROW) survivors will benefit to.

    Although we also need to remember that the H1B quota will still get filled up on Apr 1 - recession or not. So don't really know how this would turn out.

    What are your opinions folks?
