I am with you. But why you are opening so many new threads to convey the same message when already there are many active threads on top with the same message? To be frank your color coding and font making it hard to read and making me to ignore them and I am afraid people would start ignore the threads opened by you.

Hi all,
Assume that I have the following:
- I-485 has been filed for more than 180 days
- I-140 approved
- AP and EAD received
- FP done
- EB3 and priority date NOT current
I then use AC21 to port my I-140 (and the entire GC process) to another company (no problem so far). Let's say it takes 5 years before my priority is current and then I receive the GC.
My question is since greencard is for future employment, what will happen if the company that originally filed my GC goes out of business? How can I "expect" to work for the company since the company and position is no longer around?

when you use AC-21 to port, you are porting the 'future employment' company from old one to new one. SO its important that your new job offer be valid, and that company be around when its time for the 485 approval. Old company does not matter 180 days past 485 filing (if your I-140 is approved and no fraud was involved in any paperwork)

Isn't it the job of the lawyer to review the resumes submitted and build a case to say why you are the best fit for this position? I am sure that's what the DOLis looking for as well - i.e. that the companies are following the protocol of advertising the position correctly and reviewing the resumes of candidates who apply. I think it will be a red flag if you don't show any resumes at this time esp. when the unemployment is so high as opposed to showing other resumes submitted.
Rule of thumb, lawyers are not supposed to be part of recruitment process, it should be the job of HR. Lwayer can advise based on evaluation completed by HR.:mad:

You can submit a regular application along with documentations for evidence, photos plus the application fees (money order).
Once you get the FBI clearance send it to NYC (Canadian Immigration Center) along with the above mentioned documents and wait for your Visa Interview...
i sent everything to Buffallo, NY. I dont think they accept immigrant applications at the NYC consulate

Hello All,
I have only 2 months for filing a Labor certification ( 365 days before
the 6'th year H1 ends ) . My employer had alredy completed all formalities
( releasing ads ) etc required for filing labor but now I have an unusual
issue. I was under the impression , my GC will be filed under EB2 ( I have a masters and 5+ years experience) but my employer
says that the ads released was not for Eb2 but Eb3 .
My attorney says that USCIS decides the category.
1. Is there a difference in process in filing for Eb2 or Eb3 like a higher
prevailing rate ? Can I still use the same ads for filing under Eb2?
2. Does USCIS decide the category based on our qualification or while
filing itself it has to be mentioned ?
Can anyone plz clarify ?
It is the position that classifies EB2 or EB3 and You just apply (based on) for it. - You must have Bachelor Degree + 5 years of experience OR Masters + 2 years of experience to become eligible to apply. If you apply for EB3 position though you are qualified for EB2, you can not covert that position to EB2. A separate advert , recruitment efforts need to be done.

I don't know what my company's net assets are and if any debt is incurred.
My W2 shows that my gross salary from the time PD was filed till now is less.
My company attorney is saying that at the minimum, I should be getting paid the prevailing wage now and BEFORE the I-140 is filed. By attaching my pay stubs (say two pay stubs) will proof that my company has the ability to pay.
Do you think going this route will be flagged for RFE? Getting very nervous!

I am perhaps oversensitive over the issue of my home country as I weathered all 15 years of civil war in the former Yugoslavia before moving to the US 7 yrs ago.

Any immigration reforms will be initated based on the lobbying power of the biggest group (Illegals) whether legals like it or not.
