I sincere hope Dream act pass. Illegal kids suffer more. Our suffer less. Parents made mistake. Why they pay?
why do you think illegal kids suffer more? Isn't getting a visa stamped suffering these days? The whole argument about "parents made a mistake and why do you want kids to suffer" is a total BS i think. It is parents choice and parents know better about their kids.

I applied for I485 about a month ago with all the papers that were asked for ,but i got a letter saying "Request for initial evidence I-485)"
F. (40) The sponsor or joint sponsor on form I-864 affidavit of support must submit the following:
. W-2s,1099s,and /or all schedules submitted to the IRS-a copy of his/her Federal Income tax return was submitted and/or the sponsor or joint sponsor requested an extension to file his or her Federal income tax return.
What does that mean?As far as I know I already submitted all the above mentioned.I called USCIS and as usual the person on the phone didnt know anything and told us to submit it again.Will that be of any good? Please help me.I have been called for biometrics this weekend.Will it be of any use if I ask them what to do?

Did you get your denial papers, there is a date mentioned in the denial papers, you will have to respond within that date to appeal your case with supporting documents if the case is denied in ERROR (they give reasons in denial letter). If you don't respond the case is denied forever.
Also remember one thing you can't have two PERM applications open for the same company, same position and ofcourse same person. I had to withdraw my appeal to file a new PERM. some people here seem to be lucky to get perm in 2 months but for me it always took around 10 to 11 months. I lost 10 months in appeal and 2 months for withdrawal. so better decide what you would like to do.
Other option, which i am not sure is legal (or valid) would be to appeal the case and when the case status changes to pending file for H1b extension. In the mean time look if some consulting company can file PERM for you externally, if you get that PERM approved you can transfer your H1b... I mean it is easier for us to advice.. and i totally understand what you must be going through.. I was just thinking what options are open.
It would be very helpful if the option "to appeal the case, if rules were followed correctly, and extend the H1b while the appeal is pending".

Some of the volunteers have worked day and night for this purpose and they will continue to work with them on further details and we'll be making them public as appropriate.

the current clauses in the INA are being amended and the EB clauses will be directly replaced with merit based.
therefore AC21 for all intents and purposes will apply to the "new clauses"

I know enough of Law to know that there is no such thing as "all intents and purpose". Either the flow back is mandated in the new bill or it isn't. The clauses being replaced are not sub section by sub section and therefore AC21 cannot be used for the new clauses. There is no way that USCIS is going to interpret some thing like this in our favor for the fear of being sued by people like NumbersUSA, for over allocating GCs to Chinese or Indians.

I think they do provide these documents. Most of this stuff is public information and plus they do it anyways for guys they file GC.
Yes, my new company is a big company. Some of the annual reports and SEC filings are in the public domain. Some forms are definitely not for public consumption and getting this information is not an easy task and that too for the last 10 years ( my case). My "independent" attorney has responded without all these and we will see how it goes.

Practically the I-140 PP does'nt help everybody. But it helps people like me who are now zeroing in on 6'th Year.
Only with this kind of thing, i can get 3 years extension , otherwise with 1-140 being stuck, i can get only 1 year extensions which is bizarre.
They practically thought every possible scenario and selected few to help them
The guys who are whining, they will leave their employers once -140 is cleared since they might have got 485 in the last year open gate.
There are lot of things in you and your family that might need to pay attention to get things done right way.
Dont point Fingers at USCIS. They are hearing us. They have to go by whats defined to them as regulations.
We have lot of things to do on our side too before whining at someone.

Wow.. I wonder what happens to the people whose I-140 have already been approved from NSC. The Alien Registration (A#) number should have PD attached to it. But who can tell how USCIS and its' system really works.

I don't think you need anything from your employer for COBRA. Its your option to use COBRA or not.
There are many individual insurance comapnies you can use. It depends on the state. http://www.anthem.com/ plan HMO is the only one I know which covers maternity. You would need to pay $1500/year/member for hospital admissions such as maternity.
