It is really wishful thinking that 5921 will pass because it is less controversial.
Actually, none of the bills are really controversial. It is naive to think that the bills which are not getting passed are being stuck because of some politicians' reasonable objection to some sections of it.
It the three bills are not passed it is purely due to political reasons and not due to any logical reasons. In these situations, you can come up with a bill which says "2 + 2 should be 4" and it will still never make it out of the committee!! :)
If there is still hope, we should focus on getting the maximum, and see what happens. Setting the sight low right at the outset is not going to help in any case.

I am guessing you are planning to get married in Russia and applying for her H4 visa in Russia since she is currently not in the US. If she were to be in the US as a non-immigrant you would have applied for a change of status to H4 in the US.
As for the "green card" filing - you are correct - it takes more time for Adjustment of Status (last step in the process) if your country of birth is India. However, labor certification and I-140 (Step 1 and 2 respectively) has no bearing on the country of birth. When you get to the last step you can "interfile" and claim chargeability to Russia instead of India.
Yes we are planning to get married in Russia & India, Important thing is we need to get that International Marriage Registration from Moscow. Yes she is in Russia now, so I have to apply for H4 from Russia only I guess. I can apply for Green card soon and during last stage I use cross chargability provision! I will keep that term in mind..:) thanks.

I am sorry to hitchhike on someone else's thread. It seems this person needs help and I do not have an answer. Here is my situation.
I am in India now, came for H1B renewal. Although my wife got H1B, they asked more documents for me. Both of us have AP. I decided not to proceed farther with the H1b thing and enter US using AP. Will there be any problem when I enter US as I have a pending visa application? Thanks for your advice.

This is the height of being scared.
Some people create annonymous profiles because they are scared USCIS will come after them if they post anything on the web. I have known people who are so scared when their name shows up in google search and think they will be stuck in FBI namechecks. Now some people are so scared they ask their own questions by saying' they are asking for their friend'.
Ask your friend to come on the site himself and post. We wiill answer questions that are yours only.
Come on 'high skilled ' 'best and the brightest' grow up.
I don't think people should answer 3 kinds of posters:
People who ask questions for their friend.
People who create thread without proper title
People who post offenive messages
Well said.

You would have understood by now that many posters here think that "your friend" is actually "you". If that is the case, learn to face problems bravely. There is nothing wrong in admitting to a problem or failure. There is no shame in it. If you are in fact posting for a friend, ask him/her to login and ask here openly.

This is not the forum to post such questions.
I agree.
Surgery is also pyramidal in structure for most programs. So if you get in as intern, there are no guarantees that you will finish, as usually they decrease the number of residents in every subsequent years.
Also you need to know what you are getting into. If you start as J-1, you will be allowed to change specialty only once, and other thing is you cannot repeat any portion of your training on J-1. So if you start at small program and next year you get an offer to restart at a bigger program, you can only go to next level (PGY-2) and not as intern (PGY-1).
OB-Gyn might be somewhat easier to get if you are ONLY interested in surgical based training, as less american graduates are going into this due to high malpractice premiums.
The way medicare cuts are expected to happen, specialties other than primary care ones, will be losing a lot of money in next five years.
So if you decide now , whether you want to stay here or go back to India with a specialty, you will save yourself lot of grief and frustrations.
Best of luck in your search and as courtesy to other members, I couldnot agree more, that this is not a platform to raise these issues.
Admistrators should intervene, as this site is becoming like a "Inquiry box", with people asking for observerships, tax informations, input on companies and such. Given this trend, soon we will have people asking "which laundry detergent is better"?
We have more freeloaders on this website than imaginable, who use it to get their answers , and never contribute.
It might not be a bad idea to make it a paid website, or if you want to post something, put in a nominal fee for eg $1 or so, this will help with fund raising efforts.
I am a surgery resident on H1B and so is my spouse.
Surgery is difficult at this stage of the game.
PhD will NOT help. Although I have a PhD its my realization that surgery program DONOT look for PhD. it sends a wrong signal many times. This may not be true in some research intensive programs. However most research intensive programs and very tough to get in. For example, UPENN, MGH, BWH.
This is not the forum to post such questions. The way to go about it is to make contacts work in surgery programs as a research fellow and slowly climb the ladder. In general they dont care musch for Indian surgical training. I went all the way there ( will not post details for personal reasons) but here I had to start from PGY1.
But like everything in life its doable. Work hard, get your PhD ( since you are already there no way out). Find a surgery program with research and get a postdoc fellow job there. Make contacts. Write papers and present work at meetings and eventually you WILL get. I got it that way and so can you.
Lastly ONCE a SURGEON ALWAYS A SURGEON. Its hard to like anything else once you choose to go down that lane. Atleast that has been my exp.
Immigration is a huge hassle. Good Programs WILL NOT sponsor visa unless they need you and invest in you.
bye bye

Sorry about that!!!
What is this "MEATING" you are talking about . Some kind of Meat Processing stuff.
I have heard of a thing called MEETING where people gather to discuss an agenda.
I strongly think that someone should be monitoring the threads opened with headlines like "MEATING " and yesterday someone wanted a HOME WARM up. Gives a really bad impression of a community that is skilled .

Just to return to the camera from the philosophy for a sec. The Leica rangefinders have been legendary since WWII at least, and outclassed the Canon and Nikon slr's at least up to the '70 s. The lenses were widely regarded as the best in the world. My questions are whether you think that they are now gaining a foothold of superiority in digital cameras as they used to do in film. Is the sensor (not even sure what kind it is) better than your canon's? And what flows from that - are you retiring your canon gear to go Leica?

His post seemed to cause quite a problem and then he was banned.
This is an actual client who paid for an evaluation and was approved. All i am saying is that before accusations are made questions should be asked and facts gathered.
Hello Sheila Danzig,
This is regarding your post -

We do not ban anyone unless we have reasons to believe that someone is working to harm our effort.
Also, it is possible that sometimes group of members in the same workplace and they have the same external IP address. In this case, if we ban the IP address of 1 member, it does block others who are in the same network that is configured to use NATing IP configuration. We do not like banning anyone and thats an extreme step which we are forced to under the curcumstances beyond our control.
Its possible that we did not intend to block anyone purposefully, but had to make a hard choice given the circumstances. If you could please share the information about the member who you suspect was banned unfairly, we will do further analysis and will get back to you soon.
Thanks,
Team IV

Even though the dates are current they will not approve all the applications.
They will keep some applicants for Ransom for their business (USCIS) to run.
I have seen lot of approvals April 2006 and May 2006 applicants got their GC's that just for the auditing purpose for the Senate committees.

As promised, here is the update-
My wife returned on AP via ORD-Chicago without any hassel. They only asked her one question - what was her previous visa catagory?

BTW, when I was calling USCIS they were telling me the same - "if your checks wont' be cashed in 60 days, just refile again". It seems to be no problem for USCIS. My checks were finally cashed though.

This is not your individual returns.. this is for the company or he or she who is sponsoring your GC. I do not know why would they ask for sponsor's returns... may the knowledgable guys in the forum enlighten
Hope this would help.
If you are the primary applicant of 485 and your spouse is filing 485 as a dependent/family, then you are the sponsor for your spouse for 485.
Therefore, I think in this context, it means the primary applicant(who is the sponsor of dependent's I485). They are asking for W2, tax returns and other things for the primary applicant.
Send them copies of W2 for past 2-3 years and also your 1040 A or other filing forms, schedules etc. Basically whatever you sent to IRS PLUS the W2 you received from ur employer(s).
Hope this would help.

Now, supposing somebody's spouse, who is Indian but happened to be born in a country not backlogged, but for all practical purposes this person is Indian, but this couple benefits from this CC law.
Is this defeating the spirit of the law? USCIS/DHS is enforcing the letter of the law while completely defeating the reason this legislation, though archaic, was written in the first place.
I think, we, become who we are per the towns, the people and the nations we are exposed to i.e. our surroundings and the experiences sculpt who we become. So, perhaps the law applies similar reasoning over an individual's "origin" and personally, to a large extent, I agree with the law. After all we either came from Adam / Eve or from a single continent :)
